Girl, 11, charged with DUI after high-speed chase

ORANGE BEACH, Alabama (AP) -- Police who chased a car for miles along a highway at speeds up to 100 mph said the driver was drunk, hardly a rarity in this resort town. But there was more: When they looked inside the flipped vehicle with guns drawn, they found an 11-year-old girl at the wheel.

"You go up there thinking it's a felon you're dealing with," assistant police Chief Greg Duck said.

The girl, who was slightly injured in the crash, is now charged with driving under the influence of alcohol, speeding, reckless endangerment and leaving the scene of an accident. Duck said she sideswiped another vehicle during the roughly 8-mile chase.

The chase began around 10:30 p.m. Tuesday when a patrol officer near the Florida line saw the car speeding west along a beach highway, Duck said. When the officer flicked on his lights, the driver sped up. The girl rolled the car just inside the Gulf Shores city limit.

Duck said the girl, whose name was not released because of her age, told police she was on her way to pick up her sister at a concert.

Investigators found no alcohol in the car but believe the girl drank before getting behind the wheel of the car, which belongs to relatives.

Duck declined to release the girl's blood alcohol level but said a blood test at the hospital showed it was higher than .02, the legal limit for minors

I thought 0.00 was the legal limit for minors. :confused:

The legal limit for somone under the age of 21 is .02 that is the equivalent of a 150lb person having 1 beer.

In Maryland if you are under 21 and blow a .02 or higher you automatically loose you license for 6 months.

I bet that trick will work at any age if you are a hot female.

how can there be a legal limit, if its illegal to drink at all under 21...

because there are other ways to get alcohol into your system besides beer, wine and liquor....

IE: cough syrup, mouthwash, etc

Maybe legal limit is the wrong word. It could be considered the minimum chargeable limit. Any blood alcohol level under .02 is just so low you can not use it to charge people with. A level of .01 could come from cough syrup or other medicines.

Not entirely true. Persons under age 21 may consume alcohol under certin limited circumstances legally in Maryland.

When it comes to BAC, the human body naturally produces small amounts of alcohol. I'd have to look at my Intoxilyzer notes to cite a number (if I can find them...)

There could also be .02 error in the instrument but a .08 with a .02 margin of error is still drunk.

That's a pretty big margin for error...

.06 BAC is definitely not drunk by any means(1) . For many years the "legal limit" was .10 BAC. That's what was considered "drunk".

However regardless of BAC, you may be charged with DWI. The standard is "impaired", if you can show that an individual's ability to operate a motor vehicle is impaired then you can charge them accordingly.

1. Alcohol is a funny thing, some people will be greatly impaired at .08, and others won't be.

Its dependant on the individual and other variables that come into play.

But there is certainly not a .02 margin of error

The huge errors can occur with the Breathalyzer:

A professional painter, spraying for 20 minutes with a mask and cold sober, can blow .075. Even eating certain types of bread can generate a .02. That is a big margin of error.
It appears that the 11YO girl had a blood test which is more accurate but still full of variables. The point is, a BAC of .02 means nothing, in fact, a .08 means nothing to a good lawyer as the link clearly shows.
