So everyone else...if you've been pulled over and asked to do a sobriety test, was it out of the blue or did they have good reason to do it?

Checkpoint was set up by the Star of the Sea church and everyone leaving the Island was stopped. This was about 13 years ago. I had to get out of the car and do the tests. I admitted to having drinks and I am sure I smelled of alcohol.
I finally ended up blowing a .06 and was told to drive home safely.

I have a question. Is it wrong for a police officer to give someone who has had too much to drink a ride home instead of arresting them?

Define 'wrong'. In my view, that would be serving and protecting the public good. In the view of the departments legal staff, that may be just about the most wrong thing they've ever heard of.

Is not serving and protecting getting the person off of the road? It's a traffic violation.

According to the cop, not dimming your headlights is a sign of impairment.. the smell of mint on my breath was a sign of drinking (huh?? basically NOT smelling alcohol on my breath was a sign that I had been drinking).

I don't get how that is guilty until proven innocent. Are the cops not supposed to look for normal factors and do further investigation? Some indicators of an impaired driver are trying to mask the smell of alcohol with a mint. Forgetting to turn bright lights down. Along with an array of other things.

Should the police officer just forget about it?
