I recently had my van repaired at Indy's auto Care located in Indian Head Maryland. While my vehicle was in the owner's possession my rear license plate was stolen as well as $33.00 dollars worth of gas. The owner filed a police report and gave me the information. I called the owner back and asked to be reimbursed for the cost of new temporary tags $20.00 and $33.00 for the gas that was siphened. He told me he was not responsible for my loss even though he has a fenced in lot he could of kept my vehicle in instead of leaving it in the open lot across the street. I understand business owners my not be responsible for stolen or loss of items left inside of a vehicle but clearly one would think vandalizing a vehicle would be his responsibility. what should I do at this point?

Maybe small claims court?

I'd think you'd have a case simply because the business owner is responsible for your vehicle while it is in their possession.

Not unless the owner acted negligent, and I don't see this as a negligent act.

For $53 bucks? :confused:

Maybe just ask the owner for a free oil change or something like that. If this is a good shop, with good technicians, it will cost you more than $53 to search for another one that you trust.

Cut your losses and walk away. If revenge is your motive then take him to Small Claims Court. The filing fee is around $10, count on at least two trips to the Courthouse and your own wasted time and you better hope the judge doesn't think you wasted his time.

Im not looking for revenge and I did ask him if at all possible on the next repair would he be willing to deduct $50 bucks and his reply was he would come half way $25 dollars at that point I was too through and have decided that word of mouth will be his dimise.
