I remember this story...thought to myself "how can you not notice your friend's head is missing after driving 10 miles?"...drunk or not, I think I would have noticed something like THAT! Ewwww!

I'm guessing he figured his buddy had passed out.........

BUT.....you would think that after the head was severed, the body would have convulsed and it would have been apparent that the head was gone after the blood spewed everywhere.

That could be! Can you imagine getting home...pi$$ drunk...opening the door for your friend cuz you figure he is passed out and BLAM!

When I was in 6th grade we has something like this happen. The two kids were riding a dirt bike and went under a tree that had one piece of barb wire left on it...the kid in front ducked but the one in the back didn't see it and it decapitated him.

I am sure this guy is screwed up in the head now...no pun intended. I know the driver of the bike ended up being homeschooled because he wasn't able to deal with "society".

Man....

That driver wasn't thinking AT ALL... I'd say he had one mission... GET HOME... His buddy is barfing and passed out - out of the window.... :eek:nlytenmoremiles: :gethomegethomegethome:

Gets home, says to himself, "dude can just sleep it off in the car... I am too effed up to deal"

Goes to bed, wakes up... WTF!!

Some therapist will surely own a yacht after this one... :shakinghead:

Someone explain to me why he is going to jail...

The two men were on their way home from a bar after a night of drinking when Brohm stuck his head out the window because he thought he was going to be sick, authorities said.

...for this?

I have a friend who had a similar experience. They were both drunk, he was drining his Porsche at 90 mph on a wet road, hit a phone pole, killed her, his fiance.

He didn't go to jail. He lives with the guilt and the hatred of her family.

It's an accident.

:dur: He pled guilty to the charge, pretty simple if you ask me.

That pesky (meant sarcastically) drinking and driving thing...

Perhaps if his BAC weren't twice the legal limit, he may have pulled over to let his friend vomit - or not get to that point and get him safely home v. drive him through a telephone wire - then - not notice a missing head - of a childhood friend.

Not premeditated murder... But manslaughter when he chose to drive intoxicated and be responsible for the passengers in the vehicle.

It was the passengers decision to get in the vehicle, and stick his head out the window.

The driver probably swerved to save a sguirrel.

...the explained parts I understand. Now, back to the question, do you agree that this is a case where the drunk driver needs to go to jail?

He didn't hit anyone. He didn't hit anything. By the same logic, say he was sober, noticed his friend was suddenly sticking his head out to puke, our driver is startled and accidently drifts to his right as he looks at his pal to see if he's OK...clips the wire...

That's what I'm saying...

My friend did far worse, to me; He hit a pole.

This guy is guilty of some negligence, certainly drunk driving and whatever penalty that entails, even losing his privelege to drive, but jail?

I don't follow the logic of the vehicular homicide but manslaughter seems the worst that it could be. Having said that one would have to look into how the laws are worded in, I guess, Georgia to see if the fact that he was drunk while operating a vehicle and did something that resulted in a fatality is enough to make the standard.
