Which could easily explain why dougster is ordered to pay the $1400/month. If his income were $6000 6 months ago and it is only $2000K now, he has shown the ability to earn more. If CS was filed before his loss of employment, they could be going on that.
I wonder how that works though if you get fired, and then just cant find a job making that much? I mean I could see if I had a 100K a year job and was just like "to hell with it" and quit so I could work at Wal Mart for 10K a year  but if I got fired from my nice 100K job and Wal Mart is the ONLY place that will hire me, how am I supposed to pay 2K a month in CS? Does that make sense?

Ok try to concentrate....my boyfriend has 2 kids by the same woman. The son is 3 yrs old. He has had split custody of the son since they broke up. They also have a daughter together. She is 16 months. My bf's ex cheated on him...she had just gotten pregnant when they split up. She said the baby was the other man's. All of the sudden out of the blue, when the daughter is 12 months old, the ex says she wants a paternity test because she thinks the baby was really my bf's...because her current boyfriend was getting ready to leave her, and he demanded a paternity test. Lo and behold, it was my bf's baby, so he has to pay for 3 months of child support while he and the baby have an "introduction period." SO...due to her f*ck up, he has to pay child support Had he known from the beginning that the daughter was his, he would've gotten 50/50 custody and not had to pay any child support and wouldn't have missed the first 15 months of his daughter's life. It took 4 months to finally get visitation with the daughter, because the ex is an evil biatch. So they go to court, work out the 3 month intro period. Two weeks later, ex calls boyfriend and says she is getting a second job...and she wants to cut the intro period in half. But...she doesn't want to cut the cs in half....because she is just a money grubbing biotch. SO, bf agrees to pay her the full amount because by the time he paid for the lawyer to go back to court, he'd spend more than he'd save. So that is how he got screwed.

:smack: I was trying to avoid going into that whole long story..but since you weren't satisfied with any of the previous answers, you got it. Do you understand everything now?
So he only has to pay three months worth of CS  then it'll go to shared and he doesnt have to pay anything?

Damn, this looks familiar. And no, I do not understand. He should not have allowed himself to get in arrears.

WTF? You obviously don't understand. He had to pay child support for the 3 months that he didn't have her 50/50.

Yes, that's right. Fortunately, the ex doesn't know that because he makes more than her, she can still get child support, even though they share EVERYTHING 50/50. What sense does that make?

A lot of it depends why you were fired.

That is a bit of an extreme example. However, I'm betting the judge would tell you "sorry, that's life. Now go out and get another high paying job."

If you have the skill and ability to make $100,000 and settle for $10,000 it is no fault but your own if you go broke. You have given up that choice of working at Walmart for the simple fact that you have children to attend to. The judge doesn't care about you and your needs but for the children and their needs. You're capable of earning more, they're not.

Your b/f getting screwed had nothing to do with the CS system, but everything to do with a cheating #####. :bubble:

Well, that's true...but his cheating ex wanted to get him for child support from the date of the paternity test. That would've meant another 4-5 months extra for him to pay.....it wasn't his fault that she cheated on him and lied about it.

The state of Maryland doesn't care who cheated on who either.

But what if no one will hire you BUT Wal Mart :bawl: I mean supposing you did something pretty bad to get fired and everyone frowns on that kinda thing but Wal Mart.

This is why you get married before you start spitting out kids. A cheating GF isn't in breach of a legal contract but a cheating wife is.

As much as it sucks, suck it up, its only 3 months, it could be alot worse. Pray she isnt smart enough to figure out that she can get it for longer :huggy:
When I went through my divorce, I got screwed out of 10 months of CS when he was making a good bit of money, the ONE time he had a REAL job :bawl:

If you did something that bad then you'd just have to suckitup and be poor. That is your punishment for doing that bad thing. Do you think the children should have to suffer anymore?
