Legally carrying a handgun.

According to MD State Law... See my question at the end..

Application for a permit to carry a handgun is made to the Secretary of State Police. The applicant should submit a notarized letter stating the reasons why he is applying for a permit, in addition to the printed application form. The permit may be issued if the Secretary finds that the applicant:

Is 18 years of age or older.
Has not been convicted of a felony, or of a crime punishable by imprisonment for more than one year.
If the person is under 30, has not been committed to any juvenile detention center for longer than 1 year or adjudicated delinquent for a crime of violence, any felony, or a misdemeanor that carries a penalty of more then 2 years.
Is not an addict or alcoholic, nor has ever been convicted of a narcotics offense.
Has not, based on the results of investigation, exhibited a propensity for violence or instability.
Has, based on the results of investigation, "good and substantial reason" to carry a handgun, including a finding that the permit is "necessary as a reasonable precaution against apprehended danger."5

The Secretary may in his discretion add restrictions to the permit limiting the location, circumstances or time at which the handgun may be carried.

The Secretary may charge a $70.00 nonrefundable fee payable upon application. The renewal fee is $50.00. There is also a $5.00 fingerprint fee.

The permit is valid for two years after its issuance and expires on the last day of the holder's birth month. Subsequent renewals are valid for periods of three years each. Applications for renewal should be submitted 90 days prior to expiration.

A permit holder must carry his permit whenever he "carries, wears or transports a handgun." The permit authorizes the holder to carry any handgun which he may legally own or possess.

It is unlawful for a permit holder to carry a handgun while under the influence of alcohol or drugs.

An applicant may appeal rejection to the Handgun Permit Review Board within ten days after receipt of a written notice of the Secretary's action.

Okay, sounds very subjective when it comes to who gets to carry a handgun and when and where they are able to carry it. I'd like to know how difficult it is to be granted a permit to carry a handgun in MD.

Reason being this whole issue with my sister and her run in with the PG County immigrants.

The State's Attorney dropped all charges against my sister and offered up a deal to the guy who assaulted my sister, which included jailtime (apparently he's had prior arrests for 1st degree assault). The State's Attorney told this guy it was the best deal they could offer up. So he's refused and will be going to trial and will probably wind up with even more jailtime, as well as a really bad attitude.

I want my sister to be able to protect herself. I don't think him or his cronies have the nads to wander back towards my sister's house, however, I do feel they'd follow her and "take care of her" if you will, off of her property, since they know full well that she'll be unable to defend herself.

Forget a handgun, carry arround a shotgun and people will definatly leave you alone.

There are some other personal protection devices that are very effective that require no permit to carry.

Yeah, but I didn't think you could carry those around either, unless of course you have the shotgun shells locked up in a safe in toolbox, in the very nether regions of you're truck!

She's got the shotgun for home use, she just needs to be able to have something to carry around if she gets cornered in a parking lot somewhere.

Next to impossible unless you can provide proof of:
Personal Protection; must be documented evidence of recent threats and/or assaults, supported by police reports and/or notarized statements.

Qualifications

I thought I'd heard of a group of citizens that started a class action law suit because the MSP is so strict on the average Janes/Joes.

In your sister's case, if she doesn't get one...It's better to be judged by 12 than carried by six. She can take her chances with the courts if she gets caught.

Pepper spray and an ASP.

Well she most certainly has that. However, I imagine in MD that won't even be good enough.

And the thing with Pepper Spray, that's just gonna tick the guy off more. You call the police again, go through another trial, get another few months in jail, then get out so they can come right back after you.

See, this is what really gets me spun up with the anti-gun idiots. :burning:

What gets me is that we have to jump thru hoops and follow laws, while they do "whatever" and get a slap on the wrist.

A can of Easy Off Oven Cleaner, the permenant solution.

I'll have to pass that on!

I also get really torked over the lack of options for the "law abiding". The criminal element doesn't really care. They go to jail for a few months and no big deal. Unlike the rest of us that have jobs and families that need us to be around.

If my sister were to get caught with a firearm "without her papers" she'd lose her job, and her kids would be the one's to suffer for it. :burning:

More accurately Sodium Hydroxide, its used to eat flesh away from bones.

You get acid in your eyes they can fix that, but you get a base in your eyes (like Oven Cleaner) your going to be blind for the rest of your life.

Bases also burn from the inside out, once you feel the burn its too late it has already penetrated your skin. Acid gives a nice warning so you get it off your skin before it does too much damage.

My little lesson in practical chemistry.

Disclaimer: Don't try this at home.

Be real careful with using things like oven cleaner. Try to look at it this way…….you shoot the maggot, he’s dead and a really bad witness……you maim this POS maggot with some kind of chemical and he sits there whining to the judge and jury about how much the victim he is and what a monster you are for using such force against him when he was only standing there minding his own business. :barf:

Carry a magnum and be done with it. It’s much easier to dump the gun after the fact than it is to try to defend yourself with pepper spray or oven cleaner, which is only effective within a couple feet.

If you want an example of how high the bar is set here in Maryland, look no further than the corrections officers at the St. Mary's County Detention Center. These folks are all sworn corrections officers, and they do not qualify because there is no clearly discenable threat to their lives. This ignores the fact that they are threatened every day by inmates and one never knows when a "Wait Until I get Out of Here" threat is a valid one.

"Fill your hands you SOB!
The main reason why these permits are hard to get is that they are controlled by the State's Attorney General and he has vocally & in print made it well known that he is striving for a complete ban on all handguns!!! Being so close to DC, you wudda thunk these anti-gun fanatics would have learned that banning guns doesn't do a damn thing to reduce crime...it only serves to take the guns out of the hands of law-abiding citizens trying to protect themselves and family from thugs who take advantage of the ban to rob & do home-invasions.

If a criminal is going to commit a crime, he's not going to stop because guns are banned. Look at DC's homicide rate! Look at how many are committed by handguns in a locality where there is a complete ban on handguns!

I DARE anyone to cross my threshold uninvited...they will be staring eye-to-eye with Mr. Mossberg.
