St. Mary's Co. Mechanicsville Man Arrested for Handgun in a Vehicle

On June 6, 2020, Deputy Raley responded to the 43700 block of Wildewood Parkway in California, for the reported weapons violation. The witness advised he was forced out of a vehicle and the vehicle operator then discharged a firearm in the area. A short time later Deputy Budd located a vehicle traveling north bound on Route 235, being operated by a male with facial hair, matching the description of the vehicle and suspect provided by the witness. Dep. Budd conducted a vehicle stop and identified the operator to be Chad William Bowen, age 26 of Mechanicsville. Located on the vehicle’s floorboard was a loaded firearm. Bowen is prohibited from possessing a firearm and ammunition due to a previous conviction.

Bowen was arrested and charged with the following:


Handgun in Vehicle
Loaded Handgun in Vehicle
Possession of Regulated Firearm by Prohibited Person
Possession of Ammunition by Prohibited Person
Handgun on Person
Loaded Handgun on Person
Reckless Endangerment


Bowen was transported to the St. Mary’s County Detention and Rehabilitation Center in Leonardtown and has since been released on pretrial supervision.

So if there is only one gun, and it was on the floor of the car, how do they charge him with having a gun in his car, and on his person? How is the charge of a having a loaded gun not inclusive of the charge of having a gun?

It's ridiculous how many different ways they can charge you for the same single offense. This guy isn't a saint, but this is some over charging bullshit.

It is how the law is structured.

§ 4-203. Wearing, carrying, or transporting handgun

(a) Prohibited. --
(1) Except as provided in subsection (b) of this section, a person may not:
(i) wear, carry, or transport a handgun, whether concealed or open, on or about the person; (1 charge)
(ii) wear, carry, or knowingly transport a handgun, whether concealed or open, in a vehicle traveling on a road or parking lot generally used by the public, highway, waterway, or airway of the State; (1 charge)
(iii) violate item (i) or (ii) of this paragraph while on public school property in the State;
(iv) violate item (i) or (ii) of this paragraph with the deliberate purpose of injuring or killing another person; or
(v) violate item (i) or (ii) of this paragraph with a handgun loaded with ammunition. (2 charges)

Interesting to note is that all charges are misdemeanors.
