Medical Malpractice Lawyers

What happened?

I had my daughter to the doctors everyweek since November sick. They kept telling me it was a virus. Finally 2 weeks ago they sent me for a chest xray and I had to take her directly to childrens hospital where she was for 9 days with a hole in her lung. Its 6cm. They said she had a pneumonia that went untreated so long it created the abcesess. She now has a picc line and has to get medicine every 8 hours for the next 8 weeks. It seems to me it was all so preventable and Im not really happy with the idea that the hole may or may not close. Its horrible for her, not to mention the fact that someone has to be with her for her meds which run for 2 1/2 hours, which ends up with alot of time and money lost at work. Thankfully my job has been understanding, either way she comes first and I need to do what I need to do for her.

If this was a county hospital/doctor, then stay away from a county lawyer. Trust me, they all work together. Especially in St. Mary's.

Not always true. The case I had was very "county" and we had two locals battling it out. I still stand by Bryan Dugan...he'll fight to the death.

This is the most ridiculous thing I have ever heard! Lawyers work for their clients. If the money is there, it doesn't matter which hospital is involved. Local doctors and hospitals have been sued successfully by local lawyers. People like you are the ones that perpetuate this false hood!

I've known Brian Dugan for a very long time, and I can obviously tell you don't have a clue as to what your talking about.

Why didn't you go to a different Dr.?

I don't think this falls under medical malpractice.

Medical malpractice is an act or omission by a health care provider which deviates from accepted standards of practice in the medical community and which causes injury to the patient. Simply put, medical malpractice is professional negligence (by a healthcare provider) that causes an injury.

My case was serious negligence. If he would have paid attention and looked into what was making her sick, instead of diagnosing her every week with a virus, she wouldnt have the problem she has now.

Why didnt I go to another doctor? Because when someone has been your pediatrician for 12 years you assume they know what they are talking about. On my end, yeah I see what happens when you ASSUME.

It is only ridiculous because you are SMCop. You see the world through your rose colored cop glasses. I speak from experience...a worker's comp related case against St. Mary's hospital. It was a circus and it lasted 4 years, long enough for my "county" lawyer to fold when it came to his closing argument. Had concurrent case for a not-at-fault car accident with same county lawyer, 12 G's in medical bills and he came at me with a low ball 2G settlement offer. Told him to shove it up his tail and that I would let my family know about the way I was treated by the firm. Asked who my family was....told him my maiden name...oh, your dad is "so and so"??? Next thing you know, about 3 or 4 days later I get a settlement for $14K. So yes, if you are serious about winning your case and you don't want to get screwed...stay out of county.

My suggestion is to find an attorney not in the area - but if you do go with one in the area, I recommend Bryan Dugan also. He's not the attorney I work for - I would never recommend the one I work for for a med mal suit. :whistle: Anyway, the only reason I would get an attorney out of the area is to avoid conflict of interest, especially if you are suing a doctor. Reason being, is that most PI/MedMal/Acc/WC attorneys have some sort of relationship with a local doctor. I don't believe any attorney would work against their client - we always ask a prospective client who the doctor is before even entertaining an intake to insure there is no conflict of interest. Now, if you're suing a hospital....go for the gold with any local!
