Mom's fault or zoo's fault?

I say Mom's fault and she should not win her lawsuit.


The Pittsburgh Zoo & PPG Aquarium says the mother of a 2-year-old boy who was fatally mauled when he fell into a wild African dogs exhibit is to blame for her son's death and shouldn't be allowed to sue.

The zoo's attorneys made that argument in a response filed Monday to the wrongful-death lawsuit brought by Jason and Elizabeth Derkosh, whose son, Maddox, died Nov. 4 after falling over a 4-foot-tall wooden railing into the exhibit when his mother lifted him up to get a better look.

"The injuries and damages sustained by Maddox Derkosh, including Maddox Derkosh's death, were caused solely by the carelessness, negligence, and/or recklessness of Elizabeth Derkosh," the zoo's attorney wrote in the court filing. She "knew or should have known he could fall into the exhibit" and failed "to maintain a proper grasp of Maddox Derkosh after lifting him over the railing."

Reason 1: Mom is the one that lifted up and placed her son in a position of danger.
Reason 2: The Zoo has a fence there for a reason.

I will never forget when we visited the rapids at Niagara Falls... we were standing on the rock formation that had a fence between us and the edge fo the rocks. The rapids were beautiful! Spectacular in color and energy. We all laughed when a rogue wave lept through the fence and zapped a little girl on the head soaking her! She didn't know what to think! :lol:

Not long after that I was horrified to see a young couple guiding their toddler daughter and her slightly older brother onto unguarded rocks so that she could get a pretty picture of them standing on the rocks with the rapids behind them. I was stunned. I couldn't breath. All I could picture was a rogue wave washing one or both into the rapids.

We can't expect to protect all children from their idiotic parents and a parent who makes a stupid decision should not be able to put the blame on others.

You have to wonder what the hell people are thinking, and then you have to marvel that they think they can sue someone for their own stupidity.

Definitely Mom's fault. People who lack common sense should not have children. And to try to sue somebody else for her own stupidity? She's clearly not the sharpest tool in the shed.

Mom should be tried for criminal negligence, I think.


They should either spay her or give her a working brain. I would have been in jail for beating the shiat of of that woman if were her husband, unless they both think the same! Unreal stupidity!

What a heartbreaking story.

The mother probably shouldn't win the suit, but she has to metabolize the grief and the guilt that she feels somehow. That's likely what the suit is about, though she may not be self-aware enough to realize it. I wish she had someone that could help her work through what she's feeling without having to get the legal system involved. But, though it's far from ideal, this probably isn't the worst way that she could deal with her grief and her guilt.

I wonder if she has any other children.

Mom's fault

I was there a few months before this happened. I remember picking my youngest up so he could see over the railing, but I would never have stood him on top, let him sit on top, or hang him over the railing. I have seen people do it many times though
