I don't think I'd write that one off just yet. From what I can tell, Sandmann has a strong legal basis to have the dismissal overturned on appeal (assuming they appeal). The judge summarily dismissed the suit, which doesn't happen at that stage unless its for a finding in law, such as a statute of limitations. But the dismissal was based on evidence that should have been presented in court and judged on the merits.
