Assuming my working knowledge isn't too far off, and assuming the cop wasn't satisfied that the kid wasn't impaired, on what basis should he have been sent on his way? If the purpose of the checkpoint is to determine if he is impaired, and the cop didn't accomplish that, can't he be held until a determination of sobriety is made?
