New septic tank law?

A house near me that was recently sold had the septic tank replaced. The new owner told me the 1000 gallon tank had to be replaced with a 2000 gallon tank to "Bring it up to code".

Maybe. If the tank was failing or additional bedrooms had been added to the house (1000 gallons is indicated for a 3/4 bedroom house in most cases) then it might have been required to be replaced.

My guess is that the original was failing or marginal. Why it got upsized I can't hazard a guess.

The house size has not changed, still a 3 bedroom. He did mention the original tank is under the house. Maybe that's the code violation.

That still sounds strange. Usually if something is permitted when built/installed then it's grandfathered in when the Code changes until major rehabilitation is required.

Sounds like maybe the home inspection report indicated a problem because the tank was under the house so the new owner as a condition of purchase wanted the old owner to replace it?? Not necessarily a requirement of the state is my guess.

Looking though Maryland septic tank laws, i see a new law taking effect on June 1, 2026.
It requires a septic tank inspection before a deed transfer.
My 48yr old 1000 gal tank has one chamber.
Current law requires two chambers. Don't know when that started.

I can't figure out how to post a pdf file of the law.

That requires "inspected", "pumped out", and "fixed" but I don't see anything about the BAT tank sewage treatment systems being required. I do know that BAT tank systems are required if you are awarded grant money from Dep Health to replace a failed system, but I don't see anything in that link about that.

I learned last night at a political event that the politicians wanted to make childcare more affordable in Maryland so they passed a law that states a tenant can open a childcare business in the home they are renting, and the landlord cannot do anything about it, including evicting them for said business or raising the rent. This crazy crap from the Dems has to stop! They do not believe in personal property rights.

That, the daycare piece in rentals, has been around for a while. Basically, if it's an allowable use it can be done. Now, the landlord could have a lease forbidding it and would likely be OK.
