NY Bar Rules It's Ethical For Lawyers To Scour Facebook For Damaging Info


The New York Bar Association has decreed that it's okay for lawyers to troll through Facebook and other social media sites for damaging info on their opposition. There is an important caveat, though. It's only ethical if the info is publicly available. "Friending" someone for the purpose of accessing data the person only makes available to their "friends" is not kosher, nor is it cool to ask someone else to do it for you.

I'm not the least bit surprised. I have a friend (in NY) who is going through a nasty divorce. I keep telling her to keep her crap off FB because if his lawyer gets a hold of some of her rants, he'll try to convince the judge she's a complete loon and she'll be sharing custody of her kids with an abusive, cheating bastard or may lose custody completely. Yes, she's quite dramatic at times. :whistle:

Some people post their entire life story on FB. Come on now, nothing is personal on the internet. It can always be found, regardless of the bs privacy settings.

Why not just leave the keys in the door or leave the door open?

But, how bit of a PITA is it? I mean, if the same fool doesn't put his/her address on FB, what are the REAL chances of a break in/robbery?

I have a feeling it will soon become "ethical" to friend people if they're willing to let you look at their stuff. If they're allowed to interview someone and get whatever info the person is willing to answer, then same rules could apply to friending someone on FB.
