While some states allow for joint filing for "common law" marriages, Minnesota does not, and filing joint tax returns with someone who is not your legal spouse is against both federal and state law.

So if I commit a crime, but they can't prove "intent," it's not a crime?

Actually, yes, you probably would.

I know you won't understand this but this likely isn't that big of a deal. There is no major benefit to filing jointly vs filing single anymore. So to claim that someone was trying to cheat on their taxes by filing jointly is either not true or laughable because the benefit would be so small.

So all they would need to do is refile the tax returns correctly.

This VERY different than someone who, just for example, claims that their property is worth millions less than it is so that they can pay less property taxes. Or, say for example, someone claiming losses that weren't theirs to claim.

Investigation Into Omar's Campaign Finances Reveals Another Issue

Rep. Ilhan Omar (D-MN) recently came under fire for using campaign finances to pay for using campaign money to travel to Florida to accept an honorarium. She was ordered to repay her campaign $3,500 as well as a $500 civil penalty to the State of Minnesota. It turns out that investigation also revealed Omar illegally filed joint tax returns with her current husband, despite being married to another man, the Associated Press reported.

According to marriage records, Omar applied for a license in 2002 to marry her current husband, Ahmed Abdisalan Hirsi, who Omar says went by Ahmed Abdisalan Aden at the time. A marriage certificate wasn’t issued and Omar has said they didn’t pursue a civil marriage but instead married in their Muslim faith tradition. Omar and Hirsi had two children, but ended their relationship in 2008.
Omar then married Elmi, whom she said is a British citizen, in 2009, according to a marriage certificate. Omar said that relationship ended in 2011 and the two divorced in their faith tradition, but Omar didn’t take legal action to divorce him until 2017. Divorce records say Omar and Hirsi reunited and had a third child together in June 2012. Omar legally married Hirsi in early 2018, a month after her divorce from Elmi was finalized.

The question might be is did she file as married to her ex along with filing with her brother as married. Being a pol helps you get off easier.

Back then, unlike now, there was a benefit, that was used, fraudulently. So yes, this is a thing. They would have to withdraw, then refile. And pay a penalty.

The last claim has NOTHING to do with income taxes. So, if you pay property taxes, do you get to claim that your property has less value? No. The government assessors value the property. And the claims of losses are just hyperbole. Unless you have an in with the accountants????? Wondering if the IRS had a problem with the taxes, they would have already done something? Hmmmm? Something that is done on many peoples taxes are legal, but can look bad upon an individual, politically. So the protest is not valid, compared to the accusation of actual tax fraud of the rep.

  • Rep. Ilhan Omar has been accused of, but has denied, marrying her own brother.
  • In a 2017 divorce petition, she swore she hadn’t seen Ahmed N. Elmi since 2011 and didn’t know anyone who might be able to contact him.
  • Evidence shows that Elmi may have designed a website for Omar’s sister in 2019 and is living in the same city as her.
  • Omar swore she unsuccessfully tried to locate her husband through social media, yet he is on Twitter and Facebook under his own name.
  • She also swore she did not know the name of a single relative of the man she was married to.

Rep. Ilhan Omar swore under oath in a 2017 divorce filing that she hadn’t seen her husband Ahmed N. Elmi in six years and didn’t know anyone who might be able to locate him — yet he appears to have designed a website for Omar’s sister this year, according to data hidden in the source code of that website.

The Democratic Minnesota congresswoman swore that she had not been able to locate the man she married — who the Minneapolis Star Tribune says may or may not be her brother — since 2011. She swore she didn’t know the names of anyone in her husband’s family and that the two had no mutual acquaintances who might know how to contact him.

According to Elmi’s Facebook profile, after attending college in North Dakota he moved to England and then to Nairobi, Kenya — the same city where Omar’s sister, Sahra Noor, lives and works as CEO of Grit Partners. Grit Partners’ website code contains data that indicates Elmi was involved in the creation of either the company’s website or its Instagram account.
