I need some input. I am currently looking for an attorney to have my separation papers drawn. I have seen one attorney (this would be his first divorce case) and he said that I would need a "simple separation" since I am only asking that I have full custody of our three children (they have always remained in my custody) and request my name change. The hubbie can keep the house etc etc. This attorney told me that he would draw up my papers for $1500....

Is this really the amount I should expect to be paying for this?

if you and your hubby are in agreement you can write them up yourselves and just sign them in front of a witness and have them notorized. (free if you're a member of cedar point)

You can find quite a few "free" Templates on the internet. I suggest using one of those, tailoring it to fit your situation and going to the Notary as another member suggested. Very easy process!

You're in California now? Are you familiar with family law there? I would first suggest you look into the laws and see if you can get the agreement drawn up through legal mediation. It costs less and lets two adults decide to work it out the best way for them and their family. Lawyers always make things worse.

My concern is having only a 75% confidence that he will sign. If I need to go through a lawyer, I am hoping to find out if $1500 is actually a reasonable rate. To me, that is absurd but I have no experience or close friends who have been through this process.

And I have been back in Southern Maryland since January.


you dont HAVE to have signed seperation papers when you go for your final divorce. Just proof that you're living seperate for more then a year (if its a no fault dirvorce). Just makes it easier. 1500$ just seems like a lot for something you can do yourself for very cheap if not free and for something that is not legally needed. Especially with a lawyers first divorce case. If you feel more comfortable having a lawyer draw up the papers, dont be afraid to "shop" around.

Are you kidding? $1,500.00 bucks to get rid of someone legally via Lawyer? Their crooks!!

My lawyer told me that if I was going through a full divorce than it would cost me about $3000 for all paperwork and filing to be done. I'm not sure what it would be for just the speration agreement?

There are free walk-ins w/the county courthouses that have Pro bono(I think it is called) attorneys that will assist you with the paperwork. You can get the template(I think someone mentioned this already) offline. They will help you fill it out and then they will sign or you can go to a notary to have it finalized. I believe they call it Pro-Se filing?

If you go on the county courthouse website there is a 800 # for you to call and find out which days they have the walk-ins. Its certains times on certain days.. Good Luck :howdy:[

To have a legal sep. or divorce in Maryland you have to be a resident of the state for at least one year. No paper work will do anything until you have lived here until next Jan.
