Here you are, minding your own business, coming home from work or whatever on the subway, when all of a sudden a violent maniac starts threatening people on your car, advancing on a woman and her child threatening to kill them. You take action, incapacitating the threat until police can take over. Unfortunately the perp dies.

So now, all of a sudden, you are arrested and paying out enormous sums for a lawyer, being attacked by not only crazies on social media but the MSM and various nutjob progbot politicians as well.

The dead guy is a drug addict and habitual criminal with extreme mental problems.
You are a former Marine who's never been in trouble before.

But now you're going into debt and facing 20 years in prison because you intervened on behalf of your fellow commuters.

That ****ing Alvin Bragg needs to be put in a lethal choke hold. He declines to prosecute habitual violent criminals, yet goes after a good samaritan who stopped a violent attack by one of those habitual criminals.

And that ****ing Al Sharpton needs to put in a lethal choke hold as well. He's nothing but a race baiting rabble rouser sowing hate and discontent. That's literally how he makes his living.

I don't expect any better from Neely's ghetto relatives, or Al Sharpton for that matter, but I do expect better from Alvin Bragg. He's breathtakingly abusive of his power and needs to be gone. This is just another example of NYC voting like sht because they're idiot douchebags.

AND it's a great reason for avoiding anywhere Democrats rule. One minute you're minding your own business, then next minute your life is destroyed. THIS is one of those instances where it *can* happen to you, for real and not some manufactured fever dream.

NEW: Daniel Penny's chokehold on Jordan Neely is *not* what k*lled him, but was rather drugs and other effects, according to a medical expert who testified Thursday.

Forensic Pathologist Dr. Satish Chundru told jurors that autopsy records did not line up with typical chokehold de*ths.

Dr. Chundru says Neely passed away from "the combined effects of sickle cell crisis, the schizophrenia, the struggle and restraint, and the synthetic mar*juana."

The medical expert also noted that schizophrenia carries an "increased risk of sudden cardiac de*th."

Dr. Chundru also pointed to the video of the chokehold to make his point, stating there are two phases during chokehold de*ths: An unconscious phase and then de*th phase.

The doctor said Neely was "not rendered unconscious" first, therefore the chokehold must be ruled out as the cause of de*th.

Chundru previously worked as a medical examiner for local counties in Florida and Texas.

I think there's some stupid law that says he can't sue the government. Someone else can confirm that.

But think how much he's shelling out for legal defense. Even if he's found not guilty, this incident is costing him a piss TON of money. And I think I read that they wouldn't even take his case on GoFundMe because there's some rule that it can't be used for legal defense or something like that. Maybe he got a public defender, but you'd think with that dipshit Bragg breathing down his neck he'd want better than the guy that's in the system that's trying to put him away.

Meh, doesn't sound like the drugs would have done it without the "struggle and restraint" part. Shouldn't matter, he was being aggressive and threatening people therefore he needed to be restrained (And he chose to struggle). Drugs or no drugs shouldn't really matter if the intent was to protect someone from harm.

People would be smart to avoid NY state at all costs, don't even drive through it on your way somewhere. The city in particular. Nothing good happens there. I'm glad I got to visit and enjoy before it turned into a totalitarian police state with a politically motivated run amok DA.

I have no desire at this point to go back to NYC. I did drive through going to/from Maine last year. Went through at 4am and about 11am on the way back. We weren't pulled over.

I hope that when Trump is having ICE and other agencies round up illegal aliens, they round up all New Yorkers and Californians, check for conservative bona fides, and if they don't pass, ship 'em back. Or to the nearest totalitarian state. After all, they'd be much happier there, since they keep voting for that type of government.

You can bring suit against the government, but you need their permission first. As to Bragg what he has as protection is called "Prosecutorial Immunity", this is a judge made concept and not bound in law.



So ..... Judges, SCOTUS, can make laws? I was taught that only the legislative branch of government can create laws. So how can laws that make such prosecutorial misconduct actions, or similar actions illegal, not be used to prosecute these rouge prosecutors? Seems legislatures need a pass a real law to address this issue.


From the SCOTUS case ...

"The Griffith view on prosecutorial immunity became the clear majority rule on the issue. The question eventually came to this Court on writ of certiorari to the Court of Appeals for the Second Circuit. In Yaselli v. Goff, 12 F.2d 396 (1926), the claim was that the defendant, a Special Assistant to the Attorney General of the United States, maliciously and without probable cause procured plaintiff's grand jury indictment by the willful introduction of false and misleading evidence Plaintiff sought some $300,000 in damages for having been subjected to the rigors of a trial in which the court ultimately directed a verdict against the Government. The District Court dismissed the complaint, and the Court of Appeals affirmed. After reviewing the development of the doctrine of prosecutorial immunity, id., at 399-404, that court stated:

This is too funny .... "In our opinion the law requires us to hold that a special assistant to the Attorney General of the United States, in the performance of the duties imposed upon him by law, is immune from a civil action for malicious prosecution based on an indictment and prosecution, although it results in a verdict of not guilty rendered by a jury. The immunity is absolute, and is grounded on principles of public policy."

"The common-law immunity of a prosecutor is based upon the same considerations that underlie the common-law [424 U.S. 409, 423] immunities of judges and grand jurors acting within the scope of their duties." How is it "acting within the scope of their duties", to falsify out of whole cloth, manufacture false and misleading evidence against a defendant, that could result in a conviction?

Where such law only specified, "immunities of judges and grand jurors acting within the scope of their duties", SCOTUS decided to add prosecutors as well. In which they had no authority to do so.

So now it is just fine, and has been for awhile, to attempt to railroad anyone to prison.

You'll notice a commonality among "common-laws" that come about through the judicial system. They don't make things illegal, they make things permissible.

That's because, as you point out, they aren't laws. They are agreements by those in the judicial branch that they will not prosecute certain activities despite laws being on the books. So if they agree voluntarily that they will never prosecute a DA for misconduct it has the same effect as a law saying they cannot do so.

This nullification exists throughout the judicial branch. Juries can refuse to find someone guilty, despite damning evidence. Judges can throw a case out for myriad of reasons, and DAs/prosecutors can decide on their own whim if they want to prosecute something or can agree to plea bargains or just straight up make things up (like allowing pleading to unrelated lesser charges).
