Speeders/open containers

I was just watching the show, (I don't know how old it was) and the cop just said that a passenger cannot get in trouble for an open container, as long as the driver is not drinking.

This amazes me.

Is this true?

Yep. In some states the driver can even have a drink as long as they aren't over the limit.

The show has only been on the air since 2007. Either they weren't in Maryland or the cop was wrong.

Or - Ocean, was it a limo, RV, or bus? Or was it a car? That would make a difference.
