"HARRISBURG, Pa. - The Pennsylvania Supreme Court ruled that a woman who promised a sperm donor he would not have to pay child support cannot renege on the deal.

The 3-2 decision overturns lower court rulings under which Joel L. McKiernan had been paying up to $1,500 a month to support twin boys born in August 1994 to Ivonne V. Ferguson, his former girlfriend and co-worker.

“Where a would-be donor cannot trust that he is safe from a future support action, he will be considerably less likely to provide his sperm to a friend or acquaintance who asks, significantly limiting a would-be mother’s reproductive prerogatives,” Justice Max Baer wrote in the majority opinion issued last week."

it's about ####ing time this got recognized .......... i heard a couple yrs ago, different case ........ woman wants child, guy has sex or fills a turkey baster (and this maybe the difference) .... the guy was never expected to be daddy, momma did not want daddy ....... comes back on the guy 3 yrs later, I need money I am a dumb ##### .... judge ruled the agreement / contract invalid .... daddy cannot sign away parental rights 20k + back child support owned thank you very much .....


if a woman says I don't want a daddy give me a baby, and puts it in writing ..... the contract / agreement should hold up, Too ####ing bad ##### ...... you wanted the child, now you have the child .......

I don't know how guys can do that anyway. How can you just give sperm to someone you know and not want to see your kids. How do you separate yourself from the situation and say "It's just sperm" and not think of the kids as being yours :confused:

These cases always irritate me! From what I have read about cases such as this one, the men made it clear from the start that they were not interested in being fathers. I'm glad the court recognized this.

Some people want to help and be helpful. They just don't want the financial responsibility. What you and I feel is important, may not be important to someone else. If the person makes their wishes known upfront, then that should be recognized. Men don't have a right to stop a woman from getting an abortion, so if a woman chooses to be a single mother, and that is the agreement, then it should be the case.

Exactly. I don't think I could even donate an egg just because it would kill me knowing I have a kid out there somewhere.

I say- get it in writing before she is pregnant. Notorized and everything. Otherwise it's her word against yours.

I can see a few brilliant men trying the "but I had no intent of being a father" defense to get out of paying real child support (my ex tried that :lol:). And I can see the reverse: dads trying to get visitation/custody of kids from donated sperm.

But having a written agreement beforehand and the courts backing up such will protect those who legitimatly donated to friends.
