Eric Swalwell's Lawsuit Against Trump Has 'Mind-Boggling' Implications, Says Alan Dershowitz


"It certainly is a political stunt, the implications of it are mind-boggling. That means you can sue Black Lives Matter for any violence that ensued from their platform," he said.

"I guess the final implication is you can sue God for writing the Bible, because the Bible led to the crusades and other violence. And you could sue Imam's for making speeches in churches and in mosques and synagogues," he added.

Dershowitz's comments come after Swalwell, a California congressman, filed a lawsuit on Friday against Trump, Donald Trump Jr., Rudy Giuliani and Congressman Mo Brooks (R-AL), for inciting the January 6 riot at the U.S. Capitol.

The civil lawsuit was filed in federal court in Washington, D.C., and accused Trump and his allies of "inciting an attack against the Capitol that terrorized lawmakers and prevented us from doing our jobs of certifying the votes of the American people."

In the lawsuit, Swalwell alleges that Trump, Trump Jr., Giuliani and Brooks prompted the violent siege with their repeated claims of voter fraud, their encouragement that supporters come to D.C. on January 6, and through their speeches that day.

In March, Congressman Eric Swalwell filed suit against Brooks asserting that he conspired with President Trump, Donald Trump, Jr., and Rudy Giuliani to instigate the Jan. 6 attack on the Capitol and to prevent members of Congress, including Swalwell, from certifying Joe Biden as the winner of the 2020 presidential election.

To support these claims, Swalwell points to five post-election day tweets that Brooks sent out:
On November 5, 2020, Brooks tweeted that he “lack[ed] faith that this was an honest election” and said that as a House member, he would be “very hesitant to certify the results of this election if Joe Biden wins.”










“Scope of Employment” Definition

Whether an employee is acting within the scope of his employment is determined by the law of the state (or the District of Columbia) in which the relevant conduct occurred.
Since the challenged conduct here took place in Washington, D.C., the law there applies.
The Court of Appeals for the D.C. Circuit has been explicit that it does not take a narrow approach to “scope of employment” issues, but applies the test “very expansively and in essence ask whether the defendant merely was on duty or on the job when committing the alleged tort.”
Further, the D.C. Circuit has explained that because a congressman’s “ability to do his job as a legislator effectively is tied … to the Member’s relationship with … his constituents,” activities that enhance that relationship will be deemed to be within the scope of the legislator’s employment.

Brooks’ Tweets Were “Within the Scope”

In his petition, Congressman Brooks provided evidence that his tweets had been drafted by Brooks or his congressional staff and “issued from a congressional government building” during “normal congressional government office working hours” on “a congressional government Twitter account” using “congressional government electronic devices.”
More importantly, all of the subject matter of his tweets related to a matter of legislative concern election integrity – and a pending and critically important congressional issue: “whether to accept or reject electoral college vote submissions by various states” on Jan. 6 pursuant to the federal Electoral Count Act.
Since, under the D.C. Circuit’s standard, Rep. Brooks was clearly “on the job” when sending out his tweets, there simply was no legal basis for Attorney General Garland’s to have refused to issue the Westfall certification for those acts.

“I’m worried that if Republicans win in the midterm elections, that voting as we know it in this country will be gone,” Swalwell said.

“They’re already putting as many barriers to the ballot box as possible in Arizona, Florida, Texas, Georgia. And on the other side of the finish line, they’re putting in place processes where they could reverse the outcome even if we crawl through glass and run through the fire to get to the ballot box. And so if they are able to win the House, the damage they could do to permanently make it difficult to vote and just alter the way that we participate in the democratic process could be irreversible,” he added.

Swalwell added to the significance of the 2022 midterm election by noting it could be “the last election.”

“This is not only the most important election. If we don’t get it right, it could be the last election,” Swalwell said.

Eric Swalwell Says 'Kicking Every Russian Student' Out of the U.S. Should Be 'On the Table'



"Frankly, I think closing [Russia's] embassy in the United States, kicking every Russian student out of the United States, those should all be on the table," Swalwell said. "Vladimir Putin needs to know every day that he is in Ukraine, there are more severe options that could come."

The left-wing Gravel Institute slammed Swalwell's remarks on Twitter, calling his suggestion an "absolutely atrocious idea," adding that ordinary people "should not be punished for the actions of their government."

The congressman also proposed sanctioning Putin personally and completely removing Russians from the international banking system SWIFT.

President Joe Biden has since placed sanctions on Putin. But sanctioning Putin is largely symbolic since the Russian president has hidden his wealth, thus, making it difficult to freeze his assets.

Buying oil from Russia at this point in time is insane, crazy, an action done by morons.
Every country should be producing at top levels. Stop the flow of Russian money that they are using to invade other countries, because IMO Ukraine is just the first.

Well that’s easy - like Obama in Chicago or anyone in DC, the only election that matters is the primary, as the Democratic Party is so overwhelmingly strong that a primary win makes it a done deal. Nevertheless his political career was nowhere until he succeeded in a large field of competitors in his bid for Lieutenant Governor.

Unsurprisingly he ran for Senator only two years into that office. And once you’re in the Senate from Massachusetts - and a Democrat - that’s a position for as long as you want.

His career is unremarkable and it’s important to note that Crimea and the invasion and occupation of eastern Ukraine and other things happened on his watch. It’s why he’s not Secretary of State again - but climate tzar.
