Lawyer who drove off with parking boot loses appeal


In March 2006, Kirschbaum parked in a leased space in the private lot while he attend a lunch meeting at the nearby Caffe Luna. While he was in the restaurant, Quantum immobilized Kirschbaum's SUV with a boot and left a note that he could have the boot removed for a $50 fee.

Instead, Kirschbaum removed the tire with the boot still attached, replaced it with a spare and drove away. He initially refused to return the boot, telling a police officer that Quantum could bid on it on eBay, though he later turned over the boot to police.

But - you have to give him SOME credit!

The larger question is not whether he could sue the enforcement company. If he had left the boot in the parking place and gone on his way. would be be free and clear? Would the po-po have come after him for the $50.00 or would the enforcement company?

I thought it pretty ingenious of him. Wonder if I could do that?

One interesting thought as we have our own private parking lot at work that is shared with another business. Can we put boots on cars that illegally park in our marked spots? The folks are generally going to the Tex-Mex Restaurant next door and are too lazy to park in public parking.
