Case in point: An Arizona court recently ruled that a woman wanting to use her ex-husband’s saved sperm to become pregnant “outweigh[ed]” the man’s desire not to become a father. Due to this court ruling, the man could also be liable for 18 years of child support.

In 2014, Ruby Torres was diagnosed with bilateral breast cancer. She was told that after chemotherapy she likely wouldn’t be able to become pregnant. She and her then-boyfriend John Terrell decided to preserve some embryos so that she might one day be able to become a mother.

The couple would eventually marry but then divorced, according to the Arizona Republic. During the divorce, Terrell wanted to make sure Torres couldn’t use the embryos to become pregnant. He brought his case to the Maricopa County Superior Court, who ruled the embryos should go to a third party. Torres appealed, and received a win on March 14.

Excuse me ... there is a CONTRACT the judge is ignoring and they couple is divorced ..... IMHO the ex wife should have NO right to any genetic material from the former partner ... and the dumb ass should have demanded the clinic destroy such material.

That one will probably go to the Supremes and that's a shame. Lower courts shouldn't be allowed to be so stupid.

There's quite a bit of difference between fertilized embryos and sperm.

That being said, I think the contract the couple signed will take precedent when this likely goes through the appeals process.
Judge Maria Elena Cruz wrote the dissenting opinion. She emphasized that the couple signed a contract in 2014 agreeing to not use the embryos without mutual consent.

The agreement, signed at a fertility clinic, states that in the case of divorce or separation the embryos "cannot be used to create a pregnancy without the express, written consent of both parties, even if donor gametes were used to create the embryos."

I would agree that the actual situation is quite a bit different than the initial headline. The fact that these are already fertilized embryos makes it clear that at some point the man involved was open to having a child with the woman. Makes it a very complex situation to determine who has the stronger legal claim EXCEPT for the fact that there is a contract already in place that spells out what should be done in this exact circumstance. (Good idea on the part of the clinic to make the contract part of the process)
