Unbelievable Charges dropped in death of biker

There is a letter to the editor in today's Calvert Recorder written by States Atty Susan Shaw. In her lengthy explanation of what happened, she states "The case was scheduled for Nov 5. Subpoenas were issues by the Annapolis District Court Clerk's office....The MD State Police Trooper received his subpoena; but the date was incorrectly issued as Jan 5."
"When the judge called the case in district court, he was unaware of the mistake in the subpoenas for the trial date. He called for witnesses. When no one answered, he found the defendant not guilty as no evidence was offered as to her guilt"
"....Unfortunately there is a legal precept called double jeopardy that precludes trying a defendant twice for the same offenses and because of that, charges cannot be refiled"
"What occured in Court should not have happened; but because of an error, it did. Some wrongs cannot be righted or fixed. My heart goes out to the Hogan family who has suffered a second loss as a result."

MY heart goes out to all of Mr Hogan's loved ones. :poorbaby:

It's a shame

The problem for the deceedants family is that a criminal finding would have really helped them in the civil proceedings. They have a higher hurdle now.
