Can you get unemployment if you get paid through a 1099 if you were laid off?

That 1099 is only for tax purposes at the end of the year.

I would imagine if your filing for umemployment you will have to say yes I am working and that income be counted, however that works. Never been unemployed so far myself.
Too different issues I believe.

I believe, not 100% positive. You can only qualify for unemployment if you were paid through regular company payroll with federal, state taxes, etc. deducted. When you are paid with a 1099 you are considered an independent contractor and are responsible to pay your own taxes on any monies earned. Some companies do this to get around all those pesky rules, like having to pay for unemployment insurance or benefits - they have no actual employees since their people are paid via 1099 and are all "independent contractors". The company will tell you that you are their employee...yet you have none of those protections under the law.

Unless you worked enough quarters with a previous employer before starting work with the company who is paying via 1099...then you may qualify. Look at the link given earlier and call them.
