13-Year-Old Female Sexually Assaulted - Southern Maryland News, Charles County, Calvert County and St. Mary's County News

On Wednesday, Oct. 7, at approximately 7:30 p.m., officers from the St. Mary’s County Sheriff’s Office responded to a residence in the Lexington Park area of St. Mary’s County for a reported sexual assault.

Members of the St. Mary’s County Bureau of Criminal Investigations were contacted and assumed the investigation. The BCI investigation revealed that a 13 year old female was sexually assaulted by Josh A. Maddox, 37 of Lexington Park.
When confronted, Maddox responded to BCI and admitted to the allegations. He was charged with second degree rape and incarcerated at the St. Mary’s County Detention Center pending a review with the District Court Commissioner.

Where are you gettting that from :confused: It just says they went to the residence for a reported sexual assult.

True, but she is a 13 year old tart, while he will be a 37 year old sex offender.
 
If someone had vaginal intercourse with someone under the age of 14, and they themselves were 4 years or more older than the victim, then they committed second degree rape, per Maryland law - even if the victim consented.

Sometimes the distinction has to do with consent, sometimes it has to do with the use or display of a weapon, sometimes it has to do with injuring someone, sometimes it has to do with threatening someone (with various things), sometimes it has to do with someone abetting the crime, sometimes it has to do with the rape occurring in connection with a burglary. There are a lot of factors that can make a rape first degree.

It means, that a 37 year old man is alleged to have had un-consentual vaginal intercourse with a 13 year old Victim. The victim, due to her age, is unable to consent to sex with the person due to her age.

You might want to stick with claiming women are physically incapable of Rape. In Maryland, if a girl is under 16 she can consent to sex if her partner is less than 4 years her age.

In this case, it may have been consentual on her part, but his age was greater than 4 years.

It's not just consent, it's the use of force or threat of force. The age of consent in Maryland is 16, however a fifteen year old could have consentual sex with an eighteen year old if they were three years apart. A person could be four years older than a 15 year old, but still not 21, and the crime would be a misdemeanor. It becomes a felony when the person is over 21 and the person is under 16, or the person is over 18 and the victim is under 14.

You are correct in that there are several factors which could lead to the difference in charges.

Second degree still means he forced her, as far as I'm aware. It just means he had no weapon and didn't beat her up in the process. I think.

I wasnt directly addressing the 13 year old with the 37 year old, i was responding to Eddy's comment that a 13 year old can not consent to sex due to her age.
