A Time Limit on Rape

If a woman consents to having sex with a man but then during intercourse says no, and the man continues, is it rape?

The answer depends on where you live. The highest courts of seven states, including Connecticut and Kansas, have ruled that a woman may withdraw her consent at any time, and if the man doesn't stop, he is committing rape. Illinois has become the first state to pass legislation giving a woman that right to change her mind. But in Maryland--as well as in North Carolina--when a woman says yes, she can't take it back once sex has begun--or, at least, she can't call the act rape.

Go Maryland, making the news. Strange subject.

Trying to legislate what's in a woman's mind is dangerous in itself... :coffee:

What if the guy is deaf???

A guy I knew from my first command was sent to Ft. Leavenworth for 10 years for something right up this alley. Just as he was about to "finish", the girl said "no, stop". He didn't and she cried "rape". She was a Japanese national (this was in Yokosuka), yet the Japanese police refused to prosecute it. NCIS, on the other hand, slammed this guy. I felt bad for him, he was a really nice guy and a helluva tech. Perhaps he deserved some punishment, but not what he got.

This logic has inflamed feminists and editorial-page writers. "The decision is philosophically from another century, from a time when our rape laws were based on the concept of women being property of men," says Berkowitz, whose organization will push for a legislative remedy if Maryland's highest court doesn't reverse the ruling. In the meantime, the defendant is serving a five-year sentence, and the legal world continues to debate how quickly--if at all--a man must go when a woman says no.
this from a community who wants to define 'rape' as allowing off-color jokes or suggestive calendars in the workplace?

So it's all about the woman eh? :elaine:

No it isn't all about the woman but I don't believe that changing your mind after it is started isn't the correct definition of rape. Women don't have to worry about that because no man would ever start and then change his mind midway through.

I have to side with men and say that once consentual intercourse has begun it can't be rape if the woman changes her mind after it's begun. I do however think it should be a form of sexual assault; just not rape.

I guess I kind of look at it like "justifiable homicide." Yeah you shouldn't have done it but I can see why you did.

BUT, it should also be considered on a case by case basis. It could in fact excalate to rape if it gets violent or if the woman is say held down. If he's two pumps away from completion and she's done and says stop and he "finishes" well that's not rape by any means.
