I dont for a minute believe the officers should "be done" only with civil litigation. as I said, a well trained officer would NOT have done that. They Fk'ed up and should be charged with assault with intent and excessive force. My whole contention is "taking their pension" is misguided. Now, if the victim/family sues the shat out of them personally because they went beyond, wayyy beyond the scope of "color of the law", personally they can be sued outside of the employer. Can one attach their future income? Sure.Sometimes that’s not enough. I agree that the insurance companies pick up the tab that’s their purpose, but I’m not agreeing with “done” in all cases. You are entrusted with essentially the power of life and death and if you abuse that authority egregiously then you deserve to be locked up. By you I mean any officer in general, not you in particular.
Ahhhhh. So that's how bad cops circumvent losing their life savings when when they commit a crime? Just develop a separate retirement account disconnected from their employment? But how does this wash when typically police agencies contribute matching, or higher, funds to these pension accounts? That matching contribution, right there, negates any protections because of agency participation.
Pensions are taxpayer funded. Any amounts that LEOs pay is 401k or equivalent deferred compensation scheme.
You violate a citizens rights, you should not only lose qualified immunity, but every gottdamn penny of taxpayer money that will support you retirement.
LEOs are the only people that can (ostensibly) legally separate us from our freedom. The consequences for f*cking upshouldmust be very, very, very high.
