BRIGHTON - The police department has recommended felony charges be filed against a female high school teacher accused of having an inappropriate sexual encounter with a teenage student.

Charges against 29-year-old Carrie McCandless were forwarded to the Larimer County District Attorney on Thursday.

McCandless has been teaching at Brighton Charter High School for more than six years.

However, 9NEWS confirmed Wednesday night the charter's school board has voted to terminate her contract.

McCandless, a Social Studies teacher and cheerleading coach, has been under investigation since late last month.

She is married to the school's principal, Chris McCandless.

Brighton Police say she is accused of having an inappropriate sexual relationship with a 17-year-old male student.

9NEWS has confirmed the alleged incident took place the last weekend in October during a school camping trip in Larimer County.

An employee at the YMCA Estes Park Center says a group from Brighton Charter High was staying there that weekend.

This is the second time in less than a year an adult at Brighton Charter High has been investigated for having an inappropriate relationship with a student.

David Mundy, Jr., 31, used to be a substitute teacher at the school.

He pleaded guilty earlier this year to sex assault on a child and contributing to the delinquency of a minor.

Police tell 9NEWS the incident involved three girls between the ages of 14 and 16, one of whom Mundy met at the school.

Records show he and the girls admitted to "kissing" and other sexual acts at Mundy's apartment last New Year's Eve.

He faces up to 12 years in prison when he is sentenced in January.

Mundy was a Brighton firefighter at the time of the incident. He resigned in October because of the case.

Mundy also has ties to school management. He is the son of David Mundy, Sr., the chairman of the charter school board of directors.

Mundy, Sr. told 9NEWS because his son was not an employee of the school, the board was not legally required to inform parents about his arrest.

Mundy, Sr. also issued a statement saying: "We want parents to know students are safe and our primary obligation is to educate these kids."

9NEWS and 9NEWS.com will continue to follow any developments in the McCandless case.

Students and staff are expected to be notified of that investigation on Thursday.

At least he is 17, not 12! Not that it makes it OK...but It is somewhat more understandable. At 17 he is close to being a man. Still sick, but at least possibly understandable?

Sorry, but not even remotely understandable. That's like saying at least he was only going 100 MPH and not 120 MPH.

Then you have to throw the typical argument out there, if this had been the other way around (male teacher/17yo female student) would it still be "understandable"?

I don't think I would be pissed if it was my son that scored......but if it happened to my daughter.......I would kill the teacher....unless it was a female teacher of course......lol

Doesn't matter... She's over the age of consent.



But if it turns out that she had sent him IM's or SMS messages or something, then we could form us a nice pitchfork and torch weilding mob.

I was just saying it's MORE understandable than with the 11 and 12 year olds. Not that it was right or acceptable. 17 y.o. guys can be very hot. There were a few of my son's friends that caused me to wish I was younger. I'm Not condoning, just can see where it may have come from.

I was the adult and behaved, so should she. I hope they put her away for quite a while. Don't know if it counts as Statutory Rape with a 17 y.o. though.

Anyone know what the age of consent is in that area? I think it is 16 in Maryland. Also, was she approached by him and gave in or did she approach him? All things to consider from a legal point of view.

Also, check your history. Twelve was not too young to get married only a hundred years ago and 17 would have certainly been considered a man.

Of course sex out of marriage is sin, so in either case, it is wrong from my point of view.

As far as I can see, this was legal in Colorado. I don't know what they could be charging her with, unless the teacher thing makes it illegal.
