We hired Beltway Paving of Waldorf, MD to pave our driveway... The driveway has sunk and cracked in over 10 places and now over a year later they refuse to admit any fault or provide any resolution and advised us to get a lawyer... Which we did...

All the details and pictures can be found here: Beltway Paving - ALERT!

Did they do the underlaying and the asphalt, or just the asphalt itself and the builder did the underlaying?

If they just came in and paved it is quite possible they are not responsible as the ones who prepared the base did a crappy job.

Reason I bring this up is if you get a driveway overlayed on an existing driveway and something happens to the new asphalt, the company is not responsible for damage cause by the base (old driveway) and I am pretty sure it would be the same for laying down asphalt on a base/underlay they did not prepare.

It sucks, but that is probably how it will play out - unless you get a REALLY good lawyer.

They came in and prepared the entire driveway and paved it... The came back during the process after we agreed on a price and they started and suggested that we order 2 more truck loads of gravel at an additional cost of $800... We took their suggestion and spend the extra $800...

This is what I had 4 months later...

Everything is documented?

That right there will make them responsible. :yay:

I know of a good lawyer, but I think he is retiring... you can try to give him a yell and see;

Richard M Gummere - 301-870-2910 You will probably have to leave a message but he should get back with you. If he cannot do it, he can point you in the right direction.

You were really lucky to get their company name as your domain. So anyone who thinks they are going to their website will see your experience.

Still no resolve to my driveway issues... We filed a complaint with the Attorney Generals office (some better business piece) and after 3 months of dealing with that, they said that Beltway Paving does not admit to any faulty workmanship and will not work toward resolving the issue...

The only other option would be a law suit which isn't out of the question... Guess we need to consider our options, the cracks are getting MUCH worse...

I will be posting updated pictures to my website Beltway Paving Waldorf, Maryland tomorrow...

Thanks for all the help!!

Sue Them!!!

Lawsuit is the only thing that they will respond to at this time. You challenged them and they don't like that. No way after reading your story and seeing your pictures that you could lose. They will probably settle on court house steps as that way they can drag it out even more. Good luck!

I have to point out that after looking at the pics, it appears there is/was something (like a leaking pipe) running across the driveway at the two locations. The depressions are very symmetrical and even. It appears to me the problem is much below the surface and could still be there. Good luck with your suit.

I kinda have to agree, seeing the 'extra green, extra full' grass right at the driveway edge at that point (first picture). It looks like there is/was an underground drain there, or at least a runoff. The ground eroded and caved in. You wouldn't happen to have a pipe leading from the house to a leach field, would you?

It looks like a drainage pipe collapsed

:yeahthat: Looks like even if you got it patched, you'd eventually have the same problem again unless you put in underground drainage. You can't blame a surfacing company for subsurface washout.

I'm going to make a wild guess that there was a plastic pipe there, and the weight of the paving equipment crushed it.
