Family Says Wal-Mart Sold Used Player Labeled As New

COOKEVILLE, Tenn. -- The family of a 10-year-old girl who received an MP3 video player for Christmas was shocked when it found the player was loaded with explicit songs and pornographic movie clips.

Cookeville resident Daryl Hill said his daughter was thrilled to find that Santa had left an MP3 player under the tree -- until she turned it on.

"Within 10 minutes, my daughter was crying," Hill told Nashville, Tenn., TV station WSMV.

There were video clips of XXX-rated sex scenes and the pornography on the player.

"I wish I could take the thoughts and images out of her head," said Hill.

The Hills had bought three MP3 players for their children that came from a Wal-Mart store in Sparta, Tenn. It turns out one of the MP3 players had been returned to the store from a previous owner who loaded sex clips, graphic war scenes and lyrics about using drugs.

The Hills want to know why Wal-Mart would sell used merchandise as new in the first place, which is in violation of its own policies.

"If they want to be a major retailer, they need to act like it," said Hill.

The manager at the Sparta Wal-Mart declined comment on the matter and referred WSMV to Wal-Mart's corporate office.

A Wal-Mart representative e-mailed WSMV confirming that stores are not supposed to return opened packages to the sales floor. They said they are working to get to the bottom of the problem.

The Hills said they have declined Wal-Mart's offer to replace the MP3 player. They've already bought their daughter a new one and are hanging onto the controversial one until they talk to a lawyer.

Poor kid. :frown: But it sounds like the family is looking for a major payday from this and I'm sure Wal-Mart will oblige. :rolleyes:

yeah I thought it was againist federal regs to sell something "returned" as new again, the story mentioned it was againist store policy

I am wondering about the store manager or it some clueless clerk did this, either way it should cost someone their job

I would question if it is possible to verify when the content was stored on the player, because that would be pivotal to the case. (Something like a "date created" or "date stored" label; I don't have an MP3 player, so I don't know if any of them do this.)

If that information is there and proves the family right Wal-Mart should pay something; if there is no information, though, WM should not pay anything, but probably would just to end it.

Obviously, WM gives the impression that they are admitting someone did something wrong... so the family is likely already looking forward to a payday.

Depends on the manufacturer of the MP3 player and whether or not it uses hard drive based storage or static memory. Either way like most computer products anything deleted is not actually deleted, unless its formated. It might require getting into one of the firmware, or one of the other information screens for last update. If not ive seen a few MP3 players that you could see the date of the songs addition to the memory.

My sis-n-law lives in Cookeville, TN. She's here visiting. Going to show her this when she gets up. I wonder if she shops at the Walmart in Sparta? I wonder if all their mp3 players will be flying off the shelves in hope there's another "new" one, lol.

Ok so even if they took it back. And re-sold it. Which they are allowed to do, not for full price but they can re-sale.

Wouldn't you be able to figure out it was open by someone else? It's not like those packages are easy to open in the first place.

Well I know they are suppose to not sell it at full price if it has been reopened. At least bestbuy does that. When its been open that is. I dont know why someone would want to buy something that someone else has played with or touched and used. Especially when you never know what was put on a mp3 player or heck let alone anything else that you can act as a recording device.

Maye I am just crazy as why you would want to buy someones returned product ?

Well that's just it, why by something used. Then try to sue because someone else used and they weren't smart enough to check it first.

Kind of like buying a used car from a cheap used car lot, then sue because it breaks down or was broken.

i agree.. the father is a moron for starters... and secondly buying a used car at a cheap car lot seems like what alot of people would do because the " price was to good to beat"

If you set the iPod up to run as a drive letter as well (which you have to do manually), you can view all that. It would be just like plugging in a flash drive.

This is a horrible story. Wal-Mart shouldn't pay anything, though. I don't even know if someone should lose their job. I mean, if you take a product back and say, "It works, I just don't want it anymore," what else is there to do?
