Judge Issues Emergency Order Halting DOGE Access To Treasury Payment Systems


The short version of the complaint and claims is that Secretary Bessent violated various procedural requirements and that there is a threat that sensitive private information could be exposed. Considering that the Chinese government thoroughly hacked the Treasury computer systems under Biden, it’s odd that the mere possibility that DOGE might mishandle the information required a Friday night court intervention. I think there are serious ‘standing’ issues with the states bringing the case as well as the harm being speculative.

I can’t really assess the underlying merits on such short notice, other than it seems like what it is, a political objection in search of a legal theory. The Executive Branch gets to run the Executive Branch, and this seems like an overstep by a different branch of government.

This seems to be a repeat of 2017, where the Resistance had good luck with District Court Judges, less luck with Appeals Court Judges, and very little luck with Supreme Court Justices. But that’s besides the point, this is all about slowing down the Trump agenda, and wasting months or years before a final resolution is reached. Democrats don’t have to win in the end to achieve Democrats’ goals.







To be clear, what the @DOGE team and @USTreasury have jointly agreed makes sense is the following:

- Require that all outgoing government payments have a payment categorization code, which is necessary in order to pass financial audits. This is frequently left blank, making audits almost impossible.

- All payments must also include a rationale for the payment in the comment field, which is currently left blank. Importantly, we are not yet applying ANY judgment to this rationale, but simply requiring that SOME attempt be made to explain the payment more than NOTHING!

- The DO-NOT-PAY list of entities known to be fraudulent or people who are dead or are probable fronts for terrorist organizations or do not match Congressional appropriations must actually be implemented and not ignored. Also, it can currently take up to a year to get on this list, which is far too long. This list should be updated at least weekly, if not daily.

The above super obvious and necessary changes are being implemented by existing, long-time career government employees, not anyone from @DOGE. It is ridiculous that these changes didn’t exist already!

Yesterday, I was told that there are currently over $100B/year of entitlements payments to individuals with no SSN or even a temporary ID number. If accurate, this is extremely suspicious.

When I asked if anyone at Treasury had a rough guess for what percentage of that number is unequivocal and obvious fraud, the consensus in the room was about half, so $50B/year or $1B/week!!

This is utterly insane and must be addressed immediately.

If there is a way for Trump to bypass all the leftist Federal judges and go directly to SCOTUS, he needs to do that. The Dems and their leftest lapdogs on the courts are back to using lawfare.

Lets look at this: Their Attorneys paid for by Center for Constitutional Rights, the American Civil Liberties Union of New Mexico and Las Americas Immigrant Advisory Center.
Is it ok for me to ask how much USAID money they got? What is their interest in protecting gang members in America?

Can't they find some hard working illegals that could use their help?

Can the FBI get some background on these agencies?
These are not just illegals, they are gang members and criminals.
Just by his name I feel that Judge Gonzalez has a personal interest in their welfare. Maybe he should be checked out also.

The Wall Street Journal carefully curated the first major challenge to the Trump agenda into a story misleadingly headlined, “Vance, Musk Criticize Federal Judge for Blocking DOGE From Treasury System.” But the judge went much further than the headline suggests. Astonishingly, he enjoined all non-career officials from accessing the Treasury system— right up to the Senate-confirmed Treasury Secretary himself.

Judge Paul Englemayer

The biggest problem with the judge’s decision appeared right in the story. “The Democratic attorneys general,” the WSJ admitted, “said the true limitations on DOGE’s access remain unclear.” In other words, the plaintiffs didn’t know, and can’t prove, whatever they think DOGE might be doing. Under the high injunction standard, tangible evidence of irreparable harm is normally needed to get an injunction.

I reviewed U.S. District Judge Paul Engelmayer’s order. It seemed weak. The order —written in whole part by the Democrat AGs— founded the decision to temporarily stay all access to Treasury systems by “political appointees” (including the Secretary!), by citing an unnamed “heightened risk that the systems in question will be more vulnerable than before to hacking.” That unquantifiable “heightened risk of hacking,” whatever that means, seemed far from sufficient to justify a temporary restraining order.

In New York, as in most places, “a showing of irreparable harm is the single most important prerequisite for the issuance of a preliminary injunction.” Heightened risks, regardless of their speculative stature, hardly show irreparable harm.

Judge Englemayer, an Obama appointee, didn’t cite a single piece of evidence supporting the alleged threat. The hearing (if there was one) was held ex parte, meaning the Trump Administration wasn’t permitted to participate, and it looks like the “evidence” was pure guesswork by the blue-state Attorneys General. Nor did Englemayer’s order explain how state Attorneys General have standing to interfere with the federal government’s internal processes and procedures.

The whole thing was sketchy. According to the docket, the states’ motion was filed at 9:30pm on Friday night, and Judge Englemayer signed the AGs’ pre-drafted order three hours later at 1am. Since Englemayer was acting as an emergency duty judge, the case was automatically assigned to a full-time federal judge.

Late yesterday, Trump’s DOJ filed an emergency motion to dissolve the TRO. Here is the Trump motion’s first paragraph:

In other words, Judge Englemayer’s astonishing order inserted the courts fully inside the Executive Branch’s business, purporting to segregate Executive-branch goats from the lambs, dividing employees by labels of “civil service” and “political appointment,” in effect assuming direct micromanagement of the Treasury Department. Worse, the terms “civil servant” and “political appointee” are undefined and are not anything more than commonly understood jargon.

Yesterday, newly assigned Judge Jeanette Vargas, a Biden appointee, directed the two sides to first "meet and confer" this morning to see whether any agreement could be reached or at least narrow the disputed issues. Given the issues, that seems unlikely to happen. Barring that, the states’ response to the Motion to Dissolve the TRO is due by 5:00 pm, and Trump’s DOJ’s reply is due by 11:00 pm tonight.

My guess is that the TRO won’t survive the next 48 hours, at least not in its present, overbroad state.

This temporary restraining order is not the first, nor will it be the last, to be filed against the Trump Team’s Swamp draining efforts. After all, lawfare is one of the left’s favorite tools. Many lawsuits have already been filed, and more will surely be filed. I don’t plan to cover every lawsuit; rather, I’ll let you know if something significant happens. If I don’t mention it, that means I think it’s just normal legal wrangling and nothing to get excited about yet.

This order might be more interesting in that it shows the Swamp’s growing terror of Trump’s “political appointees.” Before Trump 2.0, career bureaucrats felt safe and insulated from political staff since the bureaucrats have so many ways of frustrating an incoming Administration’s team. This overreaching order shows that the long-established status quo is melting, and the Deep State is freaking out.

If the TRO gets slapped down quickly, it will be a helpful barometer for how much patience the judiciary has for these tactics. If it somehow survives in any meaningful way, it will be headed for the Supreme Court.

Just days before the 2020 election, far-left activist group Shutdown DC hosted a virtual event in conjunction with Feds for Democracy and Democracy Kitchen, entitled “Democracy Defense! Options for Federal Workers” to train federal employees “how to take action to choose democracy.”

The event suggested Trump might stage an “unconstitutional power grab” or a “coup” but that “federal workers play a key role in upholding democratic values for the entire country” and that “millions of workers across the country are in the federal service and take an oath to uphold the US Constitution, and millions more support federal government efforts as support staff, fellows, and researchers.”

Approximately 150 federal workers in the executive branch joined the call to discuss their “responsibilities” to stop Trump, according to Government Executive. Attendees were instructed to “consider ways to slow walk instructions coming from political appointees in a scenario in which the administration is denying its defeat at the polls,” according to Government Executive. One organizer reportedly told attendees to “perform duties at a foot dragging pace.”

Another speaker reportedly told attendees that “the rest of the country looks to us about what is normal and allowable.”

“We can help shape public opinion on what is right,” the speaker said, according to Government Executive.

In a series of videos purportedly from the event shared by independent journalist Millie Weaver, former Department of State official Maria J. Stephan discussed how federal employees can withhold cooperation to subvert an elected officials will. Shutdown DC did not respond to The Federalist’s request for comment to confirm the authenticity of the videos. Stephan purportedly discussed how “power” is dispersed throughout society and then “concentrated” in “Pillars of Support.” Stephan argues federal employees can subvert the will of the president by withholding cooperation because they make up one of the pillars.


“If people in these pillars of support withhold or deny their consent and cooperation, meaning they stop obeying, they stop cooperating, and they engage in protests, boycotts, strikes, a whole host of other nonviolent tactics, that if masses of people engage in non-cooperation, no ruler can stay in power,” Stephan purportedly said.

Stephan went onto say “bureaucracy” is a powerful “pillar of support” in subverting the will of an elected official — proving Trump’s point in firing swaths of federal employees

“[Bureaucrats] know how to speed things up, they know how to slow them down. They have access to critical information,” Stephan purportedly said.

Stephan also highlighted that “leaking” to the press is one tool federal workers can use, while someone identified as Comrade Lokh chimed in to say that federal workers should “leak everything you can.”

“Can I just recommend, everyone who works in the federal government, if you read the mainstream press, like who is covering your agency, who is working for Pro Publica, who is working for Politico. They all have signal accounts. Text them, leak everything you can.”

We’re Living through the Biggest Scandal of All Time

All four of the biggest scandals in U.S. history have happened in just the past few years:

(a) the cover-up of Joe Biden’s decline;
(b) lawfare against Trump;

(c) the cover-up of Hunter Biden’s influence-peddling, and now; and
(d) billions wasted, by not just the U.S. Agency for International Development (USAID), but also by many other agencies, and being uncovered by Elon Musk’s DOGE.

In this writer’s opinion, it’s all a series of causes and desired effects. The Democrat party Deep State (DPDS) loathe Trump. They used every trick in their trick bag, from “Russia collusion” to lawfare to assassination attempts, to beat him and present Hillary, then Biden, then Kamala as a superior candidate. The scams are the “why.”
The worst example is the vanishing migrant children. Some of the NGOs getting contracts from Team Biden to house unaccompanied minors (now known as “child-trafficking victims”) were getting multi-billion-dollar contracts. Over 300,000 of those children have simply vanished.

Anyone who made them vanish was, almost certainly, also paying the NGOs. That’s the scam. The NGOs were paid for taking the “raw materials” off Team Biden’s hands, and then they got paid again for the “finished product.”
Their CEOs received enormous salaries. And as we know from the corporate world, the salaries may not be the biggest part of the compensation they received. For example, here in Illinois, Michael Tipsord, CEO of State Farm Insurance, gets a salary of $2.4 million. But his bonuses were $21.8 million.

All this is for securing billions by canceling thousands of fire insurance policies in Southern California — where another disaster was precipitated by Gavin Newsom, Karen Bass, and other Democrats, again in pursuit of ideological goals

Gov. Kathy Hochul doesn’t rule out removing Eric Adams from office following allegations NYC mayor was involved in ‘quid pro quo’ with DOJ



The governor told host Rachel Maddow that she read a letter penned by now-former acting Manhattan US Attorney Danielle Sassoon that claimed Adams’ legal team offered a “quid pro quo” in hopes of seeing his federal charges get dismissed.

“The allegations are extremely concerning and serious, but I cannot as the governor of this state have a knee-jerk, politically motivated reaction like a lot of other people are saying right now,” Hochul said.

“I have to do what’s smart, what’s right and I’m consulting with other leaders in government at this time.”

“This just happened,” she added. “I need some time to process this and figure out the right approach.”

🔥 Taken all together, yesterday’s three press conferences rearranged the chess board again. Yesterday wasn’t just a response to the Deep State’s legal maneuvers—it was a full-spectrum battlefield realignment. The chess board was flipped, the rules changed, and the Swamp’s legal victories were swept away, already obsolete.

The Deep State spent the weekend celebrating its judicial bottlenecks, believing it had stalled Trump’s momentum. Instead, they woke up yesterday to three separate existential threats unfolding at the same time.

The announcement of the pending reconciliation bill put Congress on the chessboard. If Congress cuts the Deep State’s purse strings, the courts have nothing to say. The Swamp now faces the horrifying prospect that its most powerful agencies may be actually defunded, not just paused.

Take the money away, and the Deep State starves. That was the first existential threat.

Anna Paulina Luna’s Declassification Task Force threatens to start a systematic, ongoing unraveling of decades of classified secrets. But more importantly, it will give Congress the excuse to strip off the Deep State’s institutional cover, by reining in overclassification. The Deep State cannot survive in sunlight. That was the second existential threat.

Finally, Musk’s DOGE status report put uncooperative public officials on notice. It’s now a possible criminal investigation. They can resist, but resistance only draws more attention to themselves. And, while corporate media continues trying to deny it, since Elon brought receipts, the bureaucracy is on notice. The counter-leaks will continue.

The Deep State thought it could box in Trump with legal challenges, but he’s moved the fight to Congress and to public disclosure, where the judiciary has no power.

But even that wasn’t all. Trump made sure. He scorched the Earth.

DC District Judge Amir Hatem Mahdy Ali ordered President Trump to resume sending taxpayer money to foreign NGOs. The Canadian born judge who was previously president of a Soros-funded NGO before being appointed to the bench by Joe Biden.

Judge Amy Berman Jackson blocked the Russell Vought’s CFPB from terminating additional employees after he fired dozens of agency workers and cut off new funding from the Fed.

Elon Musk was appointed by the President. He has authority.

He has also been completely transparent - we hear from him personally every single day. Many times with Trump right there, so clearly Trump knows what's going on. It's the sht the pukewad politicians have been doing that's been sneaky and behind our backs.

I hope with all my heart this is the end of the Democrat Party and the GOP is being put on serious notice, because you know they're dirty too.
