Defense/accident Lawyer Suggestions?

I was in a traffic accident that I thought was minor almost a year ago. I just found out from my insurance co. that the guy has been undergoing therapy for the last year and I am about to reach the insurance payout limit. Anyone have a recommendation for a lawyer that handles this type of thing in Charles County?

I had a similiar experience 2 years ago. Minor accident, cost $1200.00 to fix the persons' car. I was sued for a MILLION DOLLARS. I couldn't believe it. Anyway, I have State Farm and they provided me with one of their lawyers who by the way was very good. He came out of Bethesda and the crook ended up with the max of my policy which was a hundred thousand dollars. Still couldn't believe that but she was addicted to pain killers. It's a long ugly story, call your insurance company and request one of their lawyers, you shouldn't have to pay a dime for a lawyer, let the insurance companies battle it out. GOOD LUCK.

My suggestion: next time you renew your auto insurance up your limits to 100k/300k per incident. Those amounts should be on both your liability and un/underinsured motorist coverage. Can't help you with your current situation, but if you should get in another accident you'll have nothing to worry about (esp if you are hit by someone with state min coverage and no assets worth suing over).

I hurt my neck in an accident 5 years ago and you'd be surprized how much a PITA "minor" injuries can be.

maybe you shouldn't have hit him?

Why exactly are you trying to get out of paying for something you caused? what was the situation of the incident? I'm assuming you must have been at fault since you're paying anything.....

I was in an accident in June. Other persons fault. After the first week of all the papers I went to a lawyer. They told me to listen to the Dr. If the Dr tells you to keep going then you do it. I have 2 bulged discs in my back, Dr says I have to come once a week to get my back pulled. The first few months they had me going 3 times a week. My back is in constant pain now, not getting any better.

This man isnt trying to get out of anything . He carries insurance for the same reason everyone does. So the Insurance will protect him from law suits that can cripple him financially. His problem is not with trying to get out of paying ,his problem is he didnt carry enough insurance, and that perhaps he is being bilked by a person knowledgeable about how to work the system.

This person is trying to save his home ,his savings, his future savings. Its why he bought insurance in the first place. Unfortunately he didnt buy enough.

To say he shouldnt have hit the man in the first place is stupid, I am sure he didnt mean to. Thats why they are called accidents instead of Intents.

Maryland law requires we all purchase insurance in the amount of at least. 10,000---20,000 and 5,000 Those are the minimums I believe.

That is certainly not near enough in todays world, as some automobiles cost
40 to 50 thousand dollars and a hospital stay of 4 days will run 20,000 dollars and up. When an artist starts milking the system it can run into mucho dinero. I dont accuse the person he hit of doing this mind you,but it does happen.

All Insurance Policies have an Aggregate Limit - which is the total amount that will be paid out in any one policy period. It sounds as though you are nearing that limit. If that is the case then the person will not be able to collect anything else from the Insurance Company and the Claim will be closed. They could only collect more from you by taking it to an outside Court but they probably wouldn't get far since they took the Claim amount that the Insurance Company offered. (I am an Insurance Agent.)

but I still say that if you had been more careful then you wouldn't have been in this situation anyhow. :shrug: I honestly can't believe that there are people defending you for that :lmao:. saying "o, they are called accidents for a reason"...uh...well..there is also a reason that one person was decided to be the cause of the accident...and thats because they effed up in some way.

Dr's say I am going to be 5-10% disabled.... .Who is supposed to pay for that?

I would suggest calling your Agent to have them find out exactly how much of a Claim amount was awarded to you. You might get lucky and he has a supplemental policy that will kick in when this one runs out. Some people have additional policies that rollover like that. Good luck to you.

Yeah, my second thought was about the money issue too. Well does she have a nice car or house you would like? at least you could get something out of it, even if it is just to sell it to get your situation paid for...but how would you feel about putting her out of car and/or house? I don't know if I could really sue someone for their estate unless I felt I REALLY deserved it.

If the person who hit you had little coverage and has no assets you can sue for then you can get money from your uninsured/underinsured motorist coverage. Your lawyer should be able to handle that for you. Been there, done that, got the tshirt. :howdy:
