Yeah, my second thought was about the money issue too. Well does she have a nice car or house you would like? at least you could get something out of it, even if it is just to sell it to get your situation paid for...but how would you feel about putting her out of car and/or house? I don't know if I could really sue someone for their estate unless I felt I REALLY deserved it.
I will try to explain this as best as I can, remember mine ended 2 years ago. I wasn't charged in the accident because it was truly an accident. Someone stopped point blank in front of me, I swerved to avoid a rear end collision, and my front car hit the side of the car to the right of me, I was only doing about 35 mph, that is what saved me. So no tickets were given, I don't and never have had anything on my record and I've been driving for about 25 some years.
Anyway, no ambulances came, the person stated she wasn't hurt. Then all of a sudden 5 days later she goes to the ER stating she was hurt in an accident that happened 5 days earlier. Bit strange don't ya think?
So we get this letter a year later stating that I have $100,000.00 limit on my policy and this person has already claimed $67,000.00 in medical bills. Unbelievable. I immediately called State Farm, they explained to me their experiences in cases like this and it was just kinda a heads up letter. They also told me I could use one of their attorneys, which I did. Wowww, once he dug up this persons' background, she had been admitted to St. Mary's Hospital not once but twice for drug addiction to oxcy-cotton (sp) So we kept a close eye on everything, then we began to offer her a settlement. She took the settlement because since the accident with me, she had another one in Calvert County!!! Total accidents for this person FIVE.
The point I am trying to get to is this, I was scared to death losing my home, we have 3 kids. I was told their is a law in the State of Maryland that if you are living in that home, and it is your main home it can't be taken. Thank goodness. I took my name off of all other assets that we had by the advice of an attorney.
