The contest is down to the top 25 now. I think tomorrow is the top 10.

I've been having an interesting conversation with the Director of Promotions via email about the professional photos issue. She insists that nobody broke the rules. Yet, I saw a ton of photo studio pics in there. This was the rule about it:

BY ENTERING THE CONTEST, YOU ARE VERIFYING THAT (1) YOU ARE THE PARENT AND/OR LEGAL GUARDIAN OF THE BABY IN THE SUBMITTED PHOTO, AND (2) THE OWNER AND PRODUCER OF THE SUBMITTED MATERIAL AND THAT NO THIRD PARTY OWNERSHIP RIGHTS EXIST TO THE PHOTOGRAPH SUBMITTED. BY SUBMITTING YOUR PHOTO IN THIS CONTEST, YOU HEREBY GRANT US A PERPETUAL, WORLDWIDE, NON-EXCLUSIVE, ROYALTY-FREE, SUB-LICENSABLE (THROUGH MULTIPLE TIERS) RIGHT AND LICENSE TO USE, PUBLISH, REPRODUCE, DISPLAY, PERFORM, ADAPT, MODIFY, DISTRIBUTE, HAVE DISTRIBUTED AND PROMOTE SUCH CONTENT IN ANY FORM, IN ALL MEDIA NOW KNOWN OR HEREINAFTER CREATED, ANYWHERE IN THE WORLD, FOR ANY PURPOSE

Alot of the photos look like they came straight out of JC Penney and such. They do not grant ownership, ever.

Hey there, I know my one friend enter her baby in the contest and she is a professional photographer. So I wonder if that rule applies if you are the owner of the professional photos. Why should she be faulted if she knows how to work a camera to her benefit.

If you can prove ownership than that is definently to your benefit. But, nobody is going to sit here and tell me that a few hundred parents own the rights to professional photos.

Socki, it seems to me that the only reason they have that stipulation about the professional pics is so that the submitter takes on full responsibility should there be any conflict of interest due to copyright.

Hey Socki,

I totally agree with you. Their rule states that if you don't have ownership you can't use the photo. I do not believe that the hundreds of entries that were obviously professional were done by the parents. Therefore, they were against the rules.

What is the point of having a rule if they are going to ignore it. We should have all submitted professional pics if that was the case.

Totally unfair contest.

There would not have been 1900 photos for people to judge had they eliminated any professional photos. All they had to do was ask for a written contract from the photographer stating that the parent owned the rights to the photo.
