Thank you so much! Common sense tells me I am right, but I can tell Dh is getting worried and just wants to pay.

I did email the attorney general (thanks for the link) now I am just going to wait and see if The builder takes me up on my offer to just drop it.

No chance you're gonna tell us who the builder is? It might be useful to other people who are looking to use them.

When it comes to finding a lawyer, the more evil the better.

I have seen Dugan in court and know a few people who have had him for various reasons. Least to say, I'm not impressed by that one.

We've been going through a similar situation on our new home the past couple months. We had our house built about 3 years ago and recently had a problem with the roof leaking. We got the builder to fix the roof and the damage it caused, all on their dime.
