Turns out that no person is an "illegal immigrant" until a US Imigration Judge declares that person as one.

Every other person has all the US Constitutional rights, thank God and the Federal Judge too.

Man, that's news to me....! I thought that if a person illegally enters a country, doesn't pay taxes, commits fraud and what not, that would make them a CRIMINAL, not a citizen or even a person WORTHY of citizenship. Hey, I don't have anything against wanting to make a better life for yourself, or your family, I am just saying, DO IT THE RIGHT WAY! Put your name on a list, and wait. My father told me once when I was a kid, " Son, anything that is worth doing, is worth doing the right way, the first time."
The people of this country DO NOT AGREE WITH YOU! If by some miracle you end up in office, try to vote the way your constituents want, not what YOU want. Moronic court decisions are going to end up being the downfall of this country.

Do not argue with the boy. You'll just make him respond and the new slogan of the boards should be "Don't incite JPC." You can do that just by saying :howdy: to him. TIA.

Nice try JPC. the only reason this decision was made was because this judge interprets the state law to conflict with thefederal statute already in existence.

U.S code 1324a - Unlawful employment of aliens

(a) Making employment of unauthorized aliens unlawful
(1) In general
It is unlawful for a person or other entity—
(A) to hire, or to recruit or refer for a fee, for employment in the United States an alien knowing the alien is an unauthorized alien (as defined in subsection (h)(3) of this section) with respect to such employment, or
(B)
(i) to hire for employment in the United States an individual without complying with the requirements of subsection (b) of this section or
(ii) if the person or entity is an agricultural association, agricultural employer, or farm labor contractor (as defined in section 1802 of title 29), to hire, or to recruit or refer for a fee, for employment in the United States an individual without complying with the requirements of subsection (b) of this section.

(h)(3) Definition of unauthorized alien
As used in this section, the term “unauthorized alien” means, with respect to the employment of an alien at a particular time, that the alien is not at that time either
(A) an alien lawfully admitted for permanent residence, or
(B) authorized to be so employed by this chapter or by the Attorney General.

I believe this judge is wrong and his decision will be overturned on appeal. The states have not only the right but the obligation to adopt local laws that reinforce federal law. The states realize this problem isn't going to be solved by the fed so they must take matters into their own hands to protect their own communities.

And as usual, JPC is several days late getting to the post. Must have been scouting out the spray paint sale at Home Depot. Needs to stock up for the upcoming defacement of public buildings.

:jameo: That is exactly the point,

the Federal law rules over the State law.

I see it as brillient, and that Federal Judge made the ruling quite clear indeed.

:jameo: Not with Bush in the White House and Gonzales pressing the case and conservative Judges on the Supreme Court, as I would say that decision is the new law of the USA immigration.

You just said it all. Judges making law rather than enforcing it. But that's not what happened here. The judge was defaulting to existing federal law, not creating new law.

I was answering to your claim:

1) We have a border patrol that is determining, every day, a person's legal status right at the border, no judge required.

2) This Judge's decision was answering to employers hiring illegals, not deciding whether someone is illegal. However, for local jurisdictions to not have the ability to determine and make a decision on a person's immigrations status is a mistake. The problem has to be addressed at the local level since it is they that are directly affected by it.

But it's quite obvious you aren't interested in eradicating crime or enforcing the law, so this is pointless.

So you support Federalism? Which is against everything the Founding Fathers wanted and hoped to create.

So you support Federalism, except when a judge acts on the Federalism?
:jameo: I am not sure what you are refering too,

but I did like this Federal Court ruling and did not like some other rulings.

It does depend much on what you mean by Federalism - link HERE.

And our First President George Washington was a Federalist.

Federalism is advancing the power of the federal government at the cost of the powers of the states. Certain laws make little sense if not applied universally, but in general the founding fathers were against federalism except as a necessary evil (provide for the common defense and all that).
And our First President George Washington was a Federalist.
George Washington quite famously had no political party. Other founding fathers were Federalists, such as Alexander Hamilton and John Adams. Almost as famously they argued quite a bit with Jefferson and Madison over the powers of the states versus that of Congress.
I would like State's rights when the States do right. :howdy:
How touchingly vapid.

When will you flaming liberals quit calling illegal aliens illegal immigrants? An immigrant is someone who comes to a country legally with the intent on living there legally and eventually becoming a citizen. Illegal aliens flood our borders each and every day illegally. Dude if you think supporting illegal aliens rights is a plus in this district when it comes to the electorate you are are a bigger moron than I thought. And that is doing something. Remember it's ILLEGAL ALIEN

:jameo: Theb point of that Court case decision Link HERE is that there are no illegal anybody until a Court of Law declares them as illegal.

So they are just people that migrate while looking for a livelihood.

The discrimination was all based on racial prejudice from the beginning.

This is yet another article that you've read without bothering to understand.

The judge ruled that a city ordinance fining landlords was illegal because it stepped on federal rules. I think this will be swiftly overturned on appeal. Local rules quite often go above and beyond federal ones, even on an area in which the federal government has Constitutional authority (immigration).

Secondly, they are illegal immigrants due to the fact that they are immigrants (persons permanently moving from one country to another) and they are doing so illegally. Once again, you cannot change the definition of words. The Supreme Court has repeatedly ruled that everyone, including illegal immigrants, have the right to some due process of law. This is not the same as granting citizenship or any other Constitutionally granted rights. The due process also doesn't declare them anything, it just ensures that they have rights in regard to any case against them.
So they are just people that migrate while looking for a livelihood.
Which there is a legal process for, a process that these people ignored, hence "illegal immigrant".

I heard a lot of Illegal immigrants send money back to their country to support their families. While I am not exactly sure of where I stand on arresting them or sending them back to their country to apply to come here legally, I admire their dedication to their family. It is a shame we have people here in the United States who would abandon their families and not suppor them, leaving the family ruined and the children to lead a life where they end up in jail!

 I have heard that claim before but from my research I find that is not true at all.

There is no abandoned families anywhere in the entire USA and for any family that has any difficulties there is resources readily available for anyone that has a real need.

So there are no families "abandoned" without support or "ruined" that leads the children to "jail" as that is just not the truth.

What we do have here created in the USA is a system that brakes up families and everyone suffers under the ignorant system and it needs to be repaired.

So we need to start helping families and stop blaming them.
