You could argue that the perp was retreating to set up and re engage. Eliminate the threat when possible. Plus that shot happens seconds into the whole shooting. Guards brain is going warp speed and ducking lead at the same time. It's easy to arm chair QB but the guard performed valiantly in that situation.
