The fact is, McDonald's was maintaining their coffee at near boiling temperatures. She would have experienced severe burns no matter what she did with that coffee. She received third degree burns on her body, but she would have had them in her mouth, had she simply drank the coffee.
McDonald's had received HUNDREDS of complaints of this kind - and they refused to change the way they made coffee. This also had been McDonald's *policy* to keep it that hot - between 180 and 190 degrees (typically, hot coffee at home is close to 140).
Tell me you wouldn't kick my azz if I served you coffee that was still bubbling from the boiling water.
The papers like to make it sound like a frivolous lawsuit, but I don't see it that way.
