Neighbor's Stuff on my Property

If crappy front doors, yards, porta potties and foreclosure notices don't bother them.......:whistle:

The guy down the street from me has several cars he's working on in his garage and driveway. One of them is jacked up on tree stumps.

Several of them were burning leaves and using noisy yard power tools all weekend.

Dogs get loose and camp out on decks and patios that don't belong to them.

We have gobs of children who play outside and make an ungodly racket, especially at the house with the trampoline.

You can hear the school's PA system all over the 'hood, starting at 8am. And when they have their school fun day on the playground, look out!

This is not a neighborhood for the easily irritated. :lol:

Oh, and the other guy down the street from me has garage parties almost every Friday night in the summer. Coolers full of crap beer so I usually bring my own.

No way could I live there because I am "easily irritated". I grew up in a house with no close neighbors and currently live in a house with no close neighbors.

I grew up in that 'hood. Nothing's changed. :lol:

I've always had close neighbors until we moved here 4 years ago. I love it here! Our parties don't disturb anyone and nobody disturbs us (well except when someone starts shooting their guns somewhere thru the woods during little man's naptime lol). I don't have patience for inconsiderate, busybody or "messy" neighbors so I'm really happy where we live. :buddies:

Which brings up another point. If my neighbor had a shed or some other hard to move item and it was only a few feet over my property line, I doubt I'd make them move it. I'd most likely just go meh, and build my fence so that it doesn't include their shed or whatever.

We're a pretty laid back bunch in my 'hood, which was one of the attractions to this house.

the only problem doing that is when someone goes and sells the property.
Unfortunately you and the current neighbor might not care but the a buyer (of either property) could make an issue out of it and it could hold up the sale.

Vrai, you don't want to ever do that. Time goes by long enough and eventually you'll be just giving them that land as the law goes..........

These might just be the reasons you have so many empty homes in your area??? :coffee:

Did you specify with the survey co. that you wanted a boundary survey and for them to establish a fence line? Or did you get a house location survey for purchase/refinance? There is a difference between the two in price and accuracy.

I wish I lived in the same part of Huntingtown you do! Unfortunately, we could only afford a house with a little over a half acre (although definitely better than .1 acres in some developments...). I grew up on a 3 acre property so I am used to not bothering anyone and not being bothered.

I would definitely have fought the tresspassing charges. We kept our fence 3 feet off the property line (actually about 12 feet in places since the neighbors drive way is on our property) and the new neighbors used a bob cat and ripped out our flowerbeds and becasue the ground was lowered by 3 foot right up to the fence our fence is leaning. I wanted to go with destruction of private property charges but hubby is making me be nice.

Southern Maryland is one of the worst places I've ever been for people feeling like they can do whatever the hellz they want.

That . Property that you give up claim to, or property of yours that someone else maintains for a minimum number of years (7?), becomes their property and can legally take claim to it regardless of your pre-exisitng platt.

I'm working that now..

Up to year 3 on two abandoned lots in my neghborhood...

Think I'll move Bubba's playground into one of the lots this year..

Talk to a real-estate attorney. If your neighbor wants to make an adverse possession claim, the fact that the encroachment only came to your attention now does set off a clock of some sort. I had an inadvertent encroachment issue in my neighborhood a couple of years ago, it was resolved amicably but there are deadlines to be observed.

I would drop the neighbor a letter that you wish to talk to him about your property lines, if he agrees to talk, come with a witness to the meeting and point out the survey markers (if he has 1/2 a brain, he has already seen the markers and it would be up to him to take the initiative and move his stuff).

Btw. If you dont care about his stuff on your land, just send him the following letter certified mail personal service:

Agreement Granting Permission to Use Property

I, Homeowner, owner of the property located at somewhereandtheother in Huntingtown, MD, give my permission to 'that neighbor' to maintain the following structures on the Xft strip of land within my xyz property line. I reserve the right to revoke this permission at any time.

That way, he can't ever claim that he had hostile possession of your property. You can still kick him off if he acts up. Adverse possession in MD is 20years iirc.
