I know you weren't playing the race card. And maybe you didn't notice the :sarcasm:

Some people, such as the NAACP, will make this about race because they can. When an African-American dies under suspicious circumstances while in government custody, some will consider it the fault of white people even if there isn't a white person within 50 miles of the place. It doesn't matter that white people had nothing to do with it, what matters is that some people will always blame white people because they founded the government and they held slaves 150 years ago, so in some people's minds a 19 year old who would rather steal cars than get a job is a victim of oppression.

I'm not saying it's right. I'm not saying that ALL black people feel this way. I'm not saying that there aren't white people who will say all of the problems in the world are caused by blacks or Asians or Muslims or whatever their ethnic group of choice. But I do find it hypocritical that when whitey jumps up and randomly blames some ethnic group, that person is considered a crackpot, but let a member of another ethnic group blame white people just as randomly and it gets time on national news.

And yes, I know the NAACP didn't come right out and place the blame on the white race, but they damn well know that by making ANY statement about this man's rights being violated (even though they were) is going to make it into a race issue because their overall agenda is to promote their own race (that's what the C means). If the ACLU or some anti-death penalty group were to make the same statement, race would not be a factor.

I understand completely what you are saying. My guess will be that whoever did this guy in, is not white. And I don't feel race should be brought into this at all, but unfortunatley it usually is.

Good find, Ken. What constitutes a personal representative? Also, every story says that the police "believe" that White was the driver of the vehicle. It would have to be established that White was, in fact, the driver of the vehicle in order for White's personal rep to be suable.
Typically it is the executor of the estate or when no will exists it would be the heirs. The arrest itself might be sufficient as it would be a civil action versus a criminal action the level of proof is less, just as when OJ was found to be liable in the civil venue and not in the criminal one.

If I was the judge (and I KNOW no judge has the backbone to do it) I'd say yes, you win, wrongful death. The State of Maryland awards you for the loss of his life.. $2.95. After legal fees, that should leave them with about $.40

If I was the judge (and I KNOW no judge has the backbone to do it) I'd say yes, you win, wrongful death. The State of Maryland awards you for the loss of his life.. $2.95. After legal fees, that should leave them with about $.40

...you got me there. Perhaps Maryland (PG County) owes back the money we've saved, or part of it, by not having to process this kid through the justice system for the next 40 years?

I really wish there was a law that people, or their estates can NOT profit from lawsuits when the person would not be in the situation had they not been committing an illegal act.

The hairy part of that is that you would have to put the perpetrator on trial posthumously to prove he was in fact guilty.

Yep, he died an innocent man. (Innocent until proven...)

There are two parts to the award, actual and punitive damages. Actual damages would be limited to his potential earnings. Not much of an award for that. The punitive damages are going to make his family very rich.
