"A potentially damaging scandal erupted today that implicates Fox News Channel personalities Sean Hannity and Oliver North in the worst kind of charitable fraud. According to complaints filed with the Federal Trade Commission and the IRS, the two right-wing icons have exploited American veterans for personal and partisan gain. The actions filed by Citizens for Responsibility and Ethics in Washington accuse Hannity and North of misusing millions of dollars collected by the Freedom Alliance, a charity they promote and control.

Similar accusations were aired recently by right-wing blogger Debbie Schlussel, who complained that the “Freedom Concerts” sponsored by the Freedom Alliance and headlined by Hannity were not donating all proceeds — estimated at more than $10 million — to scholarships for the children of wounded and killed service members, as advertised. But now CREW, which had been investigating the same allegations independently before Schlussel posted her warning, has completed its own probe and filed legal actions before the two federal agencies.

The CREW complaint to the FTC charges that “Hannity and Freedom Concerts have engaged in illegal and deceptive marketing practices by suggesting that all money generated by ticket sales for the Freedom Concerts he sponsors each summer goes to scholarships for children of killed and wounded service members.” Duane Ward, the promoter who heads Premiere Marketing, which produces the concerts, also runs Premiere Speakers Bureau — which exclusively represents Hannity and North. “After staging the concerts, Premiere donates an unknown portion of the concert proceeds to the Freedom Alliance,” according to CREW. "

"“There is little more despicable than preying upon the generosity of Americans by deceiving them into believing they are aiding the children of killed and wounded service members when the truth is most of the money is going to a for-profit venture,” said CREW executive director Melanie Sloan in a press release. “Americans deserve to know whether this high-profile charity allegedly dedicated to helping veterans and their families is really doing what it says it is.”

Not surprisingly, Hannity and North and their allies have sought to refute the charges first lodged by Schlussel. But one of the researchers who worked on this matter says there is much more that will be revealed in the coming days. "

Any other day of the week, you'd comment on how outrageous Schlussel's blogs are - like the one claiming that Obama is secretly training Hezbollah soldiers. (That would be yesterday's).

I'm willing to wait and see on this - I know that you have to have SOME overhead to run a charity. It does seem a bit over the top for overhead to be as high as 80%, but I'm not seeing the facts, just what some folks have turned up.

I find it very hard to believe they would do this willfully and deceitfully, being that you can barely find two guys more fervent in their patriotism than Ollie and Sean, however form they express it.

I'm curious about "one of the researchers" claiming more to come. What, couldn't get a name? The other is that not surprisingly, they sought to refute the charges. This comes close to putting the cart before the horse - if he's not guilty of anything, it's a completely normal response.

Sloan received her B.A. and J.D. from the University of Chicago.[4]

Prior to starting CREW in 2003, Sloan served as an Assistant United States Attorney in the District of Columbia where, from 1998 to 2003, she successfully tried cases before dozens of judges and juries. Before becoming a prosecutor, Sloan served as Minority Counsel for the House Judiciary Committee, working on criminal justice issues for then-Ranking Member John Conyers (D-MI). Sloan also served as Counsel for the Crime Subcommittee of the House Judiciary Committee, chaired by then-Representative Charles Schumer (D-NY). There, she drafted portions of the 1994 Crime Bill, including the Violence Against Women Act. In 1993, Sloan served as Nominations Counsel to the Senate Judiciary Committee, under then-Chairman Joseph Biden (D-DE).[5]

Sloan has published in the Yale Law & Policy Review and numerous other publications.[6]

Sloan serves as legal counsel for former Ambassador Joseph C. Wilson and his wife, retired CIA officer Valerie Plame Wilson,[24] whose then-classified covert identity was disclosed, leading to the CIA leak grand jury investigation and the trial of I. Lewis "Scooter" Libby in United States v. Libby (see Plame affair). Sloan is one of the attorneys representing the Wilsons in their civil lawsuit against former and current officials of the George W. Bush administration (Plame v. Cheney).

Agreeing with the Bush administration, the Obama Justice Department has argued the Wilsons have no legitimate grounds to sue.[25] On the current justice department position, Sloan, stated: "We are deeply disappointed that the Obama administration has failed to recognize the grievous harm top Bush White House officials inflicted on Joe and Valerie Wilson. The government’s position cannot be reconciled with President Obama’s oft-stated commitment to once again make government officials accountable for their actions."[25]

Established in 2001, Citizens for Responsibility and Ethics in Washington (CREW) describes itself as a “nonpartisan” public interest group that litigates and brings ethics charges against “government officials who sacrifice the common good to special interests” and “betray the public trust.”

CREW’s ultimate purpose is to use “the rule of law to bring about constructive social change” in a manner the organization likens to the 1960s civil rights movement. The "social change" sought by CREW is the transformation of America into a nation that more fully embraces leftist values and policies. Toward this end, CREW strives to discredit conservatives and Republicans it deems vulnerable to attack, with the objective of decreasing their numbers in political offices nationwide. Thus the overwhelming majority of the public officials targeted by CREW are Republicans. In September 2006, the organization issued a 241-page report -- titled "Beyond [Tom] Delay: The 20 Most Corrupt Members of Congress” -- which named 17 Republicans and 3 Democrats. The report further listed 5 “Dishonorable Mentions” -- 4 Republicans and 1 Democrat. A similar disproportion has marked the political contributions made by CREW's Board members and staffers in recent years. Between 1995 and 2004, those individuals contributed $125,245 to Democrats and $16,013 to Republicans.

Citing the existence of conservative legal advocacy groups like Judicial Watch, the Rutherford Institute, and the National Legal and Policy Center, CREW says: “Conservative groups such as these have no real parallel in the progressive arena.” While acknowledging that there are numerous leftist groups that focus on research and legislation, CREW states that such organizations “do not use litigation to target outrageous conduct.” This is the niche that CREW has carved out for itself.

CREW was founded by Democrat activists Norm Eisen (an attorney) and Louis Mayberg (a prominent Democrat donor, and co-founder of the Maryland-based mutual fund management firm ProFund Advisors LLC). CREW’s "Form 990" IRS filing for 2001 lists Mayberg as one of its three Founding Directors; the other two are Daniel Berger (a high-profile Democrat donor who in 2004 made a $100,000 contribution to America Coming Together) and Mark Penn (a fellow at the New Politics Institute, and a top Democrat strategist and pollster who not only played a key role in Bill Clinton's 1996 presidential campaign, but also served as head of "message and strategy" for Hillary Clinton's 2000 Senate campaign).

Other CREW officials have similarly deep ties to the political Left. For example, Deputy Director and Communications Director Naomi Seligman Steiner was formerly the Communications Director of Media Matters for America. CREW Special Projects Associate Lida Masoudpour was once a staffer at Media Matters and served as an intern in the office of Senator Hillary Clinton. CREW Senior Counsel Tim Mooney previously served as Senior Counsel at Alliance for Justice (AFJ). CREW Counsel Dan Roth was formerly the Dorot Judicial Selection Fellow at AFJ. CREW Research Associate Robin Powers is a former Program Associate of AFJ who interned with Vital Voices Global Partnership and the American Civil Liberties Union of Illinois. CREW Counsel Kimberly Perkins once worked as the Assistant General Counsel for the National Office of the NAACP, where she led the “Voting Rights & Redistricting Project” and “Election Protection” efforts. CREW Executive Assistant Melissa Cuerdon, who previously worked in the pharmaceutical industry, served internships at the Sierra Club and the Association of Community Organizations for Reform Now (ACORN).

On March 10, 2004, The Hill (a nonpartisan weekly newspaper covering Congress and its members) reported, "House Democratic leaders are honing an election strategy to taint the entire Republican caucus by demonizing Majority Leader Tom DeLay (R-TX)." Two weeks later, CREW sent a letter to every House member in an effort to find someone willing to file ethics allegations against DeLay. CREW found such a volunteer in then-Texas Congressman Chris Bell, who had recently been defeated in the Democratic primary and thus stood no hope of being reelected in November. In June 2004, Melanie Sloan and CREW helped Bell file against Delay an ethics complaint with the House Committee on Standards of Official Conduct. CREW’s participation in this filing was in violation of House rules, which since 1997 had forbidden non-members from filing ethics complaints. The rules permit members to transmit information from an outsider -- provided that the member: (a) discloses that the information was derived from an outside source, and (b) certifies his or her confidence that the information was submitted in good faith. Bell's complaint, which was drafted by Ms. Sloan, did not disclose CREW's involvement. The Committee eventually found Bell’s ethics accusations against DeLay "unsubstantiated."

Founded: Incorporated May 13, 2002 in Delaware by Democrat activists Louis Mayberg, Mark Penn, and Daniel Berger through a hired Registered Agent company, The Corporation Trust Company. CREW has claimed that attorney Norm Eisen was also a co-founder, but his name does not appear on any founding document or any Form 990. The first donation was a $25,000 grant from the Tides Foundation, the only income in 2002.

Registered in the District of Columbia: Registered March 15, 2006, Melanie Sloan, Registered Agent. Sloan had been the loud-mouthed executive director since 2002.

IRS Exempt purpose: Organization's purpose is to work for honest, open and truthful government by bringing legal actions, conducting research and educating the public.

Self-Description: Citizens for Responsibility and Ethics in Washington uses high-impact legal actions to target government officials who sacrifice the common good to special interests.

Actual: a far-left Democrat social-change attack group targeting Republicans and centrist Democrats in Congress and conservative non-profit groups. "[Democracy]Alliance officials see CREW as a possible counterweight to conservative-leaning Judicial Watch, which filed numerous lawsuits against Clinton administration officials in the 1990s." Washington Post CREW's Executive Director Melanie Sloan has become a mighty mouth in Washington for her zingers, pretentious outrages, and legal complaints about everybody else's ethics, but her own group has done a few things that bend the rules too.
