The problem doesn't seem to be the judges over there as much as it is the State's Attorney's Office. A quick glance and they look too lazy to prosecute with all the STET's, NP's and dismissed cases.

He was sentenced to 18 months 02/09/2004. It says in the docket entries....

COMM 02/01/2005 "HE CAN SERVE EVERY DAY UNTIL 4-12-05"



A judge refused to even reconsider that sentence.

Like I said, the problem doesn't look to be the judges over there as much as it does the S.A.O. A case has to GET in front of the judge for them to put the hammer down. Some nerve he had, because it appears that while he was incarcerated he assaulted 2 DOC employees in 3/2004. Of course at that point, he was given credit for time already served and time to still be served in his current case along with a suspended sentence for assault. :boo:

Jail term five years. Suspended term four years, nine months. That means all but three months suspended. Prosecuters can agree to suspended terms, but Judges are the only ones who can suspend. I still blame the judge.

I understand what you are saying MMDad, but you cannot overlook all the STET's, NP's and dismissed cases. That falls on the S.A.O.

Agreed. This loser should have been taken out of circulation long ago. I guess the blame is shared by the prosecuters and the judges, unless the Sheriff was bringing him in on weak charges (which I don't believe.)
