Don't think that's quite legal. You have to notify someone that you want their product. Not that you don't want it. They put it on my units and they will hear from a lawyer.

Better to call to opt out then wait for them to install. They installed a DCU on my AC while I was out of town on vacation. They screwed a box to siding, cut a hole in my AC and wire the box to my compressor without my permission even though their website states the homeowner must sign a service agreement prior to hardware installation. I was not notified that anyone was coming that day and I did not sign up. I called the next day I returned to have it removed. They wanted to schedule an appointment to have it removed even though they didn't schedule to install. They removed the unit leaving holes in my siding.

Sounds like :bs: to me. The unit is installed inside, so they can't install it without your knowledge unless they're into B&E as well. Also, the FAQ on the website says:
Do I have to sign anything?
Prior to installation, our technician will ask you to sign a service order authorizing the installation of your new equipment and guaranteeing your satisfaction with the work.

So, they're going to get written authorization before installing anything. So...don't sign it.

Those of us who had already been enrolled in the previous "load management" program which is now no longer operational and who have not yet signed up for CoolSentry are recieving written notifications stating... and I'm paraphrasing...

"We assume that since you belonged to the old program you must want to take advantage of the new program. If you do not contact us saying you 'decline' we will automatically hook you up to CoolSentry DCU which does not require installation of our thermostat. In fact, you don't even have to be home! We will soon be in your area and will add the new device to your outdoor AC Unit and you then be automatically enrolled. Your welcome!"


So, yes, Yle... they ARE coming around and implementing CoolSentry DCU if receive the written notice and ignore it.

Ok, so they are upgrading equipment that they own and you previously agreed to having. They already have your approval through the old program. That is a completely different situation than someone like me who was not part of their old program and hasn't agreed to be in the new program. They can't install it without my written approval.

Actually their old equipment is installed in my laundry room next to my water heater and they aren't touching that... but yes, the "we are in your area and will automatically install CoolSentry DCU" applies to those of us who were in the previous load management program.

This brings up an interesting question. If I have the CoolSentry thermostat in my home it can regulate the A/C unit from the central station. How will the DCU unit on the A/C outside regulate? If they break into the unit to touch the wiring, and if the A/C unit should somehow be rendered inoperable....will SMECO pay for replacement of the system? If the compressor burns, the coolant poisons the entire system. All (including the units inside) will have to be totally replaced at the cost of $thousand$. I know because SMECO burned my system 10 years ago.
