BOSTON - A Boston woman who gave birth after a failed abortion has filed a lawsuit against two doctors and
Planned Parenthood seeking the costs of raising her child.

The complaint was filed by Jennifer Raper, 45, last week in Suffolk Superior Court and still must be screened by a special panel before it can proceed to trial.

Raper claimed in the three-page medical malpractice suit that she found out she was pregnant in March 2004 and decided to have an abortion for financial reasons.

Dr. Allison Bryant, a physician working for Planned Parenthood at the time, performed the procedure on April 9, 2004, but it "was not done properly, causing the plaintiff to remain pregnant," according to the complaint.

Raper then went to see Dr. Benjamin Eleonu at Boston Medical Center in July 2004, and he failed to detect the pregnancy even though she was 20 weeks pregnant at the time, the lawsuit alleges.

I think she has a strong case, do u?

I saw the story this morning and my first thought was that I feel sorry for that little girl, who will grow up knowing that her mother wanted her dead SO BAD that sued the people who didn't kill her.

But, yes, I think she has a strong case and will probably win.

Don't you know... Her mother will tell her what happened: I couldn't afford to have a kid (then why didn't you think about this when you were effing the dude to start with - Andy) at the time. I had to get an abortion for your own good. Besides, you weren't even alive yet (even though a fetus is a living species - Andy).

Because adoption is cruel. You don't know who you're kid's going to end up in the hands of... :rolleyes:

Note: I do not support abortion and do agree with Vrai. I'm just pulling out whatever talking points I can, as pointless as they are on this matter...

RIGHT! and then sue for malpractice....cuz no matter how u look at it, thats what it is.

if the doctor didnt perform an abortion what WAS he doing down there and in there???

She could have brought the malpractice suit even if she had given the child up for adoption. It's still malpractice. She still had to carry the child, lose time from work, transportation to and from doc appts, medical bills, pain and suffering, etc.
