Taking down a tree

Anyone know the legalities? I have one in my front year that grew kind of cockeyed and hangs over the driveway. In the winter when it snowed it blocked the drive. It's an evergreen and just plain ugly and of no use. It's fairly small; maybe 8 ft tall, 4-6 inches in diameter. It would be easy to just cut down but is it legal?

It depends a lot on where you live. Critical area?

There are a lot of things that are a :nono:. Well not a :nono: but you have to get "approval" for first. I'll take my chances when it comes to an ity bitty tree especially if it's legal otherwise. Especially since I plan on replacing with attractive trees once I've got the lot cleared to my liking.

If it is less than 5" at five feet above the ground, you can take it down. Any bigger, and you have to request permission, unless it's dead.

If it's too big, kill it first then take it down.

:huggy: Thanks for the warning though; since that's what I was looking for.

It's probably right around 5" but more like 8' tall. It's all mangled anyway from taking off branches when it snowed. It lookes all ragged and ghetto.

I live in the woods anyway and there are only like 4 houses on my street. I don't think anyone will mind.
