It is inapproprate to make a life sentence for rape.

Maybe the repeat rate is 99%, but i am concerned about making sure the 1% who won't repeat don't get unfairly penalised.

This compromise means the dumb frat boy who got drunk and raped some girl passed out on his bed will do an appropraite sentence for rape, but not face a life sentence. This guy is probably not going to repeat offend.

And the civil commitment procedure could/should be able to distinguish.

Porno is in the mind of the perceiver, and i can't conceive of ANY
photo of a 2 years old, in ANY position that is the least bit
sexually provocative. Heck, my mum had picture of my poopy bum when
she was changing diapers, and in the hands of a porno expert, surely
those were sexually explicit photos by a poopy-bum fanatic, but really
they were photos of what a mother sees whilst changing a diaper.

The grandpa has not molested the child, and it strikes me that one
persons photo of a nakid baby is another persons pornography, and this
is the problem... that we must sanitize our lives, and erase our
private bits from our family photos for fear that they'll be put on
