seriously, how can you take anything else from that passage. Its clear as can be and has been set in precedent throughout the years through court decisions...... the states have the right to regulate anything not delegated to the fed, or that is prohibited for them to regualte in the constitution.

Perhaps you're aware that The People's Republic of Maryland ALSO has a Constitution, which limits various governmental controls over her citizens, and limits infrigement upon local government's rights.

It's been a while since I've read it, but I'm fairly certain that cigarettes are not addressed within it's pages, and that freedom for the people is the default for non-addressed issues.

sounds like a bunch of assumptions that support your point, nothing more.
besides, smoking has not been made illegal, there have only been limits put on smoking in public places.

so according to your postition, no laws against the possesion of herion are constitutional?

thats not at all what this says

what it says is that things that are not delegated to the fed, or prohibited by the constitution, are reserved for the states to govern.

well news flash, the states are governing these issues. it doesn't have to be spelled out in the consitution that they can, just not spelled out in it that they can't.

New flash you non reading, non understanding, don't have rights if you don't understand person. You left out the most important part; "or to the people." And the Maryland constitution does not give the state the power to regulate personal health issues or eating habits.

Try reading this. Maryland Constitution - Declaration of Rights
