Linda has never been behind on rent! The judgement is for an amended portion of the lease that was slipped in at the last minute and not acknowledged for 2% off of the top line of her gross!!!!! She has been fighting it with her and I swear to you every step of this processs has been illegal and the #####es are going down!
Your response is typical of today's society. People continue to avoid taking personal responsibility for their actions and obligations. Landlord's getting a percentage of the business is not an uncommon thing. Regardless if she was behind in her rent or failed to pay the 2% she was still in breach of contract. It is amazing that everytime someone can not live up to a contract in whole or a portion of it, something was always slipped in at the last minute. One should never sign an agreement unless they fully understand it and if they do not seek legal counsel at that point, signing it is at their own peril. Maybe she sought out SM Today/Mama Leone owner's advice on how to pay your debts. If thats the case we can understand why she didn't pay the 2%
No one wants to see small business owners fade away, but they have some responsibility to make sure they are abiding by their contacts and fulfilling their obligations. I wish Linda well and hope she is able to reach an agreement on this issue. I also hope if she reopens that someone is able to light a fire under the staff to get them moving at peak times. Service is very slow and the food is not as good as her LP store.
