Chapter 9 of 21USC is the codification of the FEDERAL FOOD, DRUG, AND COSMETIC ACT, this legislation is what is used to establish the section of the Code of Federal Regulations that the FDA relies upon for their operations. So the FDA's hand is within that rule/regulation making.
