repost for better poll choices.

In another thread there is a raging debate as to what is really a sex crime and what is not.

The crux of the matter is what should be considered a "crime". Most states, if not all, have an "age of consent". If you are above the age established you can consent to having sex with whoever you want. If you are under the age of consent you cannot consent regardless. now many states have loosened up this because if the age of consent is 15 and a 15 and 16 year old engage in sex the 16 year old would now be a felon even though their ages may be different by only a few weeks.

The argument in the other threads is about legislatures even having an age of consent with regard to sex, and if they do what it should be?

I'm still fleshing this out, but here's how it would work in Vraiville:

14 would be your age of consent if your "partner" is no more than 4 years older than you.

Then 18 or older is a free-for-all.

For example, if a 14 year old gets consensually jiggy with an 18 year old, the 18 year old is not committing a crime. A 17 year old has a 21 year old boyfriend, that boyfriend is not breaking the law.

Although I'm on the line about if some skeezy 14 year old seduces a 30 year old man. And, yes, 14 year olds can seduce, and also look older than their years. So if some kid sneaks into a bar and picks up a grown man, should he go to jail if he doesn't realize how old she is and takes her up on it? I say No.

And, frankly, there's a part of me that would either make 14 the age of sexual consent, period, or do away with consent laws altogether.

Again, what are the laws regarding ages to marry?

I dunno  I am interested to see what the consensus is as to the minimum age people think can bang without penalty.

Where do you draw the line and youthful passion becomes child molestation?

I was thinking 14 too.

They vary state by state. In some states you can marry at 14 with parental consent. And other states have no age limit, but you must have parental AND court consent. I think New York and Texas have no age limit on marriage.

You honestly believe that an 18 year old Rico Suave high school graduate with a fart can road racer Civic should be banging a 14 year old 9th grader?

IMO the age of consent should be 18, but I'll settle for 16. That being said, both parties of underage sex should be held accountable. The 14 year old little skank should have to have a record too if the guy who nailed her has to have one.

If a 30 something sleezeball is picking up a chick in a bar, he should have the reasonable expectation that the chick is at least 21, unless the girl or someone else tells him otherwise.

Wasn't it Errol Flynn who did that. Chickie in heels and make-up and sexy clothes, tells him she's 20-something, turns out she's 14. I think she and her mother set him up for blackmail money. Girl shows up in court in pigtails, a pinafore and Mary-Janes.

I don't think kids should be banging at all, but I was roundly shouted down when I suggested that you can indeed curtail teen sexual activity by parental involvement.

The old "they're gonna do it anyway" argument.

So, that being the case, I feel that if public schools, which are state run and fundeed can teach children about safe sex and alternate sexual behavior, the same state has no real business prosecuting something that they are actively encouraging.

So there.

:dodgeball: What do YOU think? In the other thread you are incensed that kid sex is a crime.

I have a problem with a 14 year old and an 18 year old.... I mean, the 14 yo is in 8th or 9th grade, the 18-yo is a senior in high school. How many 14-yo girls are gonna be blinded by the fact that this cool, older guy is interested in her? She thinks he "loves" her. :blahblah:

And let's say the roles are reversed...18-yo girl, 14-yo boy.... what's that about? That's creepier to me because of the maturity level of most 14-yo boys.

Someone in the other thread said something about 11-yo w/ a 12-yo...I know it happens, but I can't see that being the kid's fault...I see that more on the parents...what lead up to kids that young having sex? At what point is it a social services issue and at what point does it become criminal?

That is an excellent point. If some 14 year old girl sneaks into a bar and picks up a 22 year old, you have to wonder where the parents are that she was out carousing like that.

Adult behavior...

...is drinking alcohol, serving in the armed forces, driving and having sex, not necessarily in that order or all at the same time.

We should have one age for them all.

Statistically, 16 year olds are a menace on the roads but I can't bring myself to raise it to 17 or 18 even though being able to drive at 16 increases your ability to get drink and sex.

It seems 18 year olds are more than capable of pretty much any job in the military, so, I'm good with that.

I cannot support handing an 18 year old a rifle and then tell him no drinking. So, I'd make drinking 18 again.

Anyone under the age of 18 caught having sex should be punishable by having to care for an infant orphan for 30 days for each offense. Anyone over 18 having sex with anyone under 18 should have to care for two orphans for two months for each offense. If the infant is not well cared for or if you break it, the sentence's are doubled. If that doesn't work, you have to teach 16 year old to drive. If that doesn't work, you have to join the armed services. And can't drink.

Pete, if Boy is 17 and has a 15 year old girlfriend, do you think that makes him a child molestor and he should serve 10 years in jail?
