Further decline of western civilization......

California's supreme court ruled that a ban on gay marriage was unlawful Thursday, effectively leaving same-sex couples in America's most populous state free to tie the knot in a landmark ruling.
In an opinion that analysts say could have nationwide implications for the issue, the seven-member panel voted 4-3 in favor of plaintiffs who argued that restricting marriage to men and women was discriminatory.

Yes it's a "victory" for state's rights, BUT the court overturned a referendum. So how is this a good thing?

This is a victory for civil rights, freedom and equality. :yay:

But the court overturned a referendum. This issue was voted on by the citizens of the state of California, BUT the state supreme court decides that the will of the people is not a valid argument in this case.

It's not. Who the frick are the people to tell the minority crowd who they can and cannot marry? What effing business of it is theirs? How does it affect them?

Hypothetical - The voters vote on a referendum that once again segregates schools and placed all the whites at North Point and the blacks at Westlake?

Should the will of "the people" matter then?

The people are "We the people"

Search on that phrase, and read the document it comes from.

When it comes to freedom and equality, the people don't have the right to limit those freedoms on a certain group of individuals. At the least, they shouldn't.

I think gay marriage is morally wrong, but it's not affecting me in any way whatsoever so why should I even care in the first place?

It's amazing the people in a socialist state like California are the ones to oppose equality.

What Is Democracy? - Defining Democracy

Majority Rule and Minority RightsAll democracies are systems in which citizens freely make political decisions by majority rule. But rule by the majority is not necessarily democratic: No one, for example, would call a system fair or just that permitted 51 percent of the population to oppress the remaining 49 percent in the name of the majority. In a democratic society, majority rule must be coupled with guarantees of individual human rights that, in turn, serve to protect the rights of minorities--whether ethnic, religious, or political, or simply the losers in the debate over a piece of controversial legislation. The rights of minorities do not depend upon the goodwill of the majority and cannot be eliminated by majority vote. The rights of minorities are protected because democratic laws and institutions protect the rights of all citizens

...that's soooooo gross! I'll bet them damn queers do all sorts of sick stuff together. Laundry, grocery shopping, pay bills, paint the house, plan for the future, go on vacations, worry about health care, buy cars together. Have friends and family over at their queer homes.

Sicko's.

All humor aside, my only support of a Federal Gay Marriage Amendment (either for or against) was due to how would states that dont support Gay Marriage handle gay couples that move into their state. I saw a Federal Gay Marriage Amendment resolving that.

But then i guess it would be handled the same way CommonLaw Marriage is, so maybe its moot ¿

...clause states that duly approved licenses and contracts in one state are to be accepted in another. The issue will be settling in another state. Maryland has a right to demand you, coming from, say, Virginian, get a Maryland drivers license if you move here and re-register your vehicle. They don't dispute the validity of your license or ownership of the car; they just demand state licensing and registration. Maryland, which as of now, bars gay marriage, will have to find some sort of legal-ese to deal with this.

It's simply a matter of time until a gay Roe v. Wade comes along and makes everyone accept gay marriage.
